MINUTES <br />CITY COUNCIL <br />OCTOBER 13,1999 <br />CONCEPT The Council reviewed the City Planner's report dated October 8, 1999 <br />REVIEW - relative to the concept rezoning of the McCumber and Buetow properties. <br />REZONING It was noted that the Planner has pointed out that the Business <br />OF McCUMBER Warehousing Zone (BW) does not allow for contractor's shops. <br />AND BUETOW However, the City has the option of amending the Code to include <br />PROPERTIES contractor shops as either a permitted use or conditional use. The <br /> rezoning of the McCumber and Buetow properties to BW would exclude <br /> Che more intense manufacturing uses that are allowed in the I-1 District. <br /> The Planner pointed out in his report that a second option would be to <br /> rezone the properties to PUD and limit the range of uses that would be <br /> allowed while still setting the future, long-term vision of the property as <br /> residential. <br />Charlie Bartholie, attorney representing the McCumber's, reported that the <br />McCumber's oppose the rezoning of their property from I-1. They <br />appreciate the fact that the City is trying to consider existing land uses as <br />part of their deliberations, bat feel their property should continue with an <br />I-1 zoning. Bartholie reported that the McCumber's have expended a <br />substantial amount of money on their property in reliance on the I-1 <br />zoning. He relayed the history of their purchase and development of the <br />site as well as the fact the McCumber's were told they could not build a <br />single-family home on the property. Bartholie reported thlt without the <br />I-1 zoning, the McCumber's would lose a significant amount of their <br />investment. <br />Bartholie reported that the McCumber's have provided the City with a list <br />of the tenants which lease this site from them. Bartholie reported that if <br />the property is rezoned from I-1, the manufacturing uses currently allowed <br />would no longer be permitted. Bartholie acknowledged that the current <br />business could continue to operate even though the property is rezoned; <br />however, if those businesses leave, there would be a question with <br />whether or not new tenants would qualify to occupy the space under new <br />zoning standards. <br />Bartholie reported Chat the MeCumber's did significant work in <br />developing their property. Substantiai soil correction work was done. <br />Four feet of soils were removed and the site was compacted to <br />accommodate a commercial building. If the site is rezoned to residential <br />and the existing building demolished, the blacktop would have to be <br />removed and the cornpacted soils removed. <br />Bartholie reported that the McCumber property is on the boundary of a <br />low-density residential housing area. However, it also abuts County Road <br />D and 35E. The property north in Vadnais Heights is zoned for <br />commercial use. Within two blocks of the McCumber property, there is <br />
