MINUTES <br />CITY COUNCIL <br />OCTOBER 13,1999 <br />Scalze asked if an Interim Use Zoning District would be an option. The <br />City Administrator reported that the Interim Use District requires the <br />consent of the property owner to enact. <br />Scalze felt that the PUD District was not really an option. Scalze also <br />questioned broadening the BW District to allow contractor's shops given <br />the effect this could have on other properties in the City zoned BW. <br />Scalae pointed out thaC BW uses are typically mini-storage and fairly quiet <br />uses that mesh with residential areas. Scalze asked about establishing a <br />sunset time for the existing use of the McCumber and Buetow properties. <br />Fahey felt that the BW zoning was closest to accommodating the existing <br />uses on the McCumber and Buetow properties. Fahey felt that rezoning to <br />BW would allow the property owners to transition their properties to BW <br />uses. Fahey acknowledged that the existing uses, however, would be <br />allowed to continue. <br />Morelan asked about the issue raised at the Planning Commission <br />meeting. Once a non-conforming tenant leaves, could the space be leased <br />to a tenant with a similar use. Fahey replied that a new tenant would have <br />to fit the BW zone. The City Attorney agreed. <br />Morelan indicated that he had no problem with McCumber's use of the <br />property nor with the Buetow's use as long as it complied with the zoning <br />ordinance. Morelan indicated that his concern was intensifying the <br />industrial use of the property. Morelan suggested that the entire Council <br />may have the goal of preventing the industrial use from being intensified. <br />However, that may be difficult to do without significantly impacting the <br />McCumber's and Buetow's. <br />Scalze pointed out that the Buetow's have not expe~ded a lot of money on <br />their property. Scalze pointed out that it is a tough decision whether or not <br />to rezone these properties. However, the Council has to look toward the <br />future and suggested that perhaps rezoning to BW is the way to go. <br />Fahey indicated that he supported rezoning to BW that provides a better <br />transitional use than I-1 with no impact on the immediate use of the <br />property. BW zoning allows the existing businesses to continue with <br />some potential restrictions in the long-term. Fahey stated that he would <br />favor a long-term goal of residential development, however. <br />Bartholie requested that if the Council rezones the property to BW, that <br />the BW District be expanded to include contractor's shops with some light <br />manufacturing or fabricating use. <br />
