MINUTES CITY COUNCIL OCTOBER 27, 1999 VARIANCE FROM REAR YARD SETBACK - 209 RYAN DR. - ROGER STANKE future owner ofthe property could not claim that the property actually consists of two separate parcels. The Planner noted that typically large accessory buildings are approved for lar~e lots. Vacating the alleyway would eliminate the possible claim that 30 West Demont, in fact, two properties. Scalze asked about Day Avenue that is shown on the County's section map. Graczyk indicated that Day Avenue has been vacated. The City Administrator pointed out that the County section map does not reflect this vacation. It was the consensus of the Council that if Day Avenue has not been vacated, it should be. Ayes (5) Fahey, Morelan, LaValle, Scalze, Pedersen. Nays (0). Resolution declared adopted. Fahey opened the public hearing to consider an application for a Variance from the rear yard setback requirement of twenty (20) feet allowing a five (5) foot rear yard setback for 209 Ryan Drive as requested by Roger Stanke. Fahey noted that the Planning Commission and the City Planner have recommended approval ofthe Variance. There was no one present from the public wishing to comment on this matter. Upon motion by Morelan, seconded by LaValle, the public hearing was closed. Mr. Morelan introduced the following resolution and moved its adoption:
