MINUTES <br />CITY COUNCIL <br />NOVEMBER 10, 1999 <br />with Mr. Rossow, he has agreed to keep the area in front of the landscape <br />structures clear from snow. <br />Scalze asked what the Zoning Code said about structures such as this in <br />the right-of-way. Scalze felt that the City would be setting a precedent by <br />allowing these landscape structures to remain. She was also concerned <br />about the resulting agreements that would have to be entered into relative <br />to snow removal issues. <br />The Zoning Administrator reported that the Zoning Code says that the <br />boulevard area of the public right-of-way should be green area. However. <br />throughout the City there are residential property owners as well as <br />business property owners who have placed improvements on the right-of- <br />way. The City has taken the position that should these structures or <br />improvements be destroyed as a result of work necessary in the right-of- <br />way, the City will not restore the improvements. <br />Scalze pointed out that there are four access drives for 3101 Spruce Street. <br />She suggested that without the landscape structures, there would be fewer <br />access points. <br />The Zoning Administrator indicated that the property had been two <br />separate lots at one time with two accesses per lot. The Zoning <br />Administrator further reported that she had the City En~ineer look at the <br />issue of the access points for this property, and he recommended that two <br />oversized access driveways be allowed. However, he did not object to the <br />four that exist and indicated that they do not cause a problem for traffic <br />flow. <br />Mr. Rossow reported that 3101 Spruce Street is the largest parcel in Ryan <br />Industrial Park. He also pointed out that the Frattalone property has three <br />access drives. Rossow indicated that the site cannot function without the <br />four accesses given that all the traffic moves into and out of the site within <br />a half-hour. The four accesses are needed to separate bus traffic from <br />vehicular traffic. Mr. Rossow described each of the four access points and <br />how they function. <br />Morelan felt that the four access points made sense for this property given <br />the nature of the business. Fahey a~reed, and also indicated that he was <br />comfortable with the landscape structures as they exist with the <br />modifications proposed for the structure around the fire hydrant that have <br />been described this evenin~. <br />Scalze did not support the landscape structures and felt that they presented <br />a problem for snow removal. <br />
