MINUTES
CITY COUNCIL
NOVEMBER 22, 1999
CUP - 3151 Council noted that the Planning Commission has tabled action on
COUNTRY DR. - the application for Conditional Use Permit for open and outdoor
COSTANZO storage of materials and equipment as an accessory use at 3151 Country
Drive pending additional information.
Pedersen introduced the following resolution and moved its adoption:
RE.SOLUTION NO. 99-I1-239 - Tf1131.ING ACTION ON THE
APPLICATION FOR CONDITIONAL USE PERMIT FOR 3151
COUNTRY DRIVE AS REQUESTED 73Y CARL CO.STANZO
PENDING A RECOMMENDATION FROM THE PLANNING
COMMIS.SION
The foregoing resolution was duly seconded by Scalze.
Ayes (5) Pedersen, Scalze, LaValle, Fahey, Morelan.
Nays (0). Resolution declared adopted.
BUETOW/ The Council reviewed the City Planner's report dated November 19,
McCUMBER 1999 relative to the concept rezoning of the Buetow and McCumber
PROPERTIES - properties. It was noted that the Planner is suggesting a B-I District
CONCEPT (Business Industrial) for these properties. The Planner noted that the
REZONING property owners were concerned about the rezoning of their properties to
PUD (Planned Unit Development), specifically with references to future
residential use of the property and with the requirement that Industrial
uses be required to go through the CCTP process. The Planner indicated
that while he has removed the reference to the future residential use, he is
recommending that any industrial uses of the property be required to have
a Conditional Use Permit.
Mr. Bartholie, representing the McCumber's, indicated that they have met
with City staffto discuss the issues on two different occasions. He
indicated that they originally had three concerns, two of which have been
resolved. Their remaining concern is that industrial uses will require a
CUP rather than bein~ permitted uses. Bartholie pointed out that there are
two existing tenants of the McCumber property that this would affect as
well as pointed out the effect this would have on the McCumber's ability
to attract new tenants. Bartholie indicated that tenants will not want to go
through the CUP process and will look for other locations. He also felt
that the CUP requirement will affect the McCumber's lease ne~otiations
with potential tenants. Bartholie requested that industrial uses be allowed
as permitted uses rather than conditional uses.
