MINUTES <br />CITY COUNCIL <br />NOVEMBER 22, 1999 <br />ALLOWABLE The City Planner reported that there has been some confusion over <br />SETBACK allowable setback encroachments. The Planner indicated that the <br />ENCROACH- materials in the Council agenda are for information purposes at this <br />ENTS time. He will be putting some options together for clarifying the Zoning <br />Ordinance, and will present them to the Planning Commission for a <br />recommendation. <br />GOVERNMENT The City Administrator reviewed the recommendation of the City's <br />CHANNEL Cable TV Committee with regard to a proposed Government Channel <br />ACCESS POLICY Access Policy. This Policy will be used by staff relative to requests the <br />City might receive for use of its Cable TV access channel. <br />Morelan indicated a concern with Appendix A relative to prohibiting the <br />broadcast of lottery information on the City's channel. Morelan stated that <br />it was his understanding that any gambling function in the City could not <br />be advertised on the channel. <br />The City Administrator indicated that iFthe intent is to promote a specific <br />gambling activity, that sort of advertisement would be prohibited on the <br />City's cable TV channel. However, if the intent is to promote an event <br />such as Canadian Days or LCRA's Softball-On-Ice Tournament where a <br />gambling activity may occur, that sort of promotion would be allowed. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOI,UTION NO. 99-11-245 -ADOPTING THE COVERNMENT <br />CHANNEI, ACCES.S POLICY AS RECOMMENDED I3Y THE CITY'S <br />CA13LE TV COMMITTEE <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Scalze, LaValle, Pedersen, Morelan, Fahey. <br />Nays (0). Resolution declared adopted. <br />CABLE TV The Deputy Clerk reviewed the proposed resolution before the Council <br />LEGISLATIVE in support of the City's retention of its authority to franchise local cable <br />ISSUES TV franchises as well as collect franchise fees which would support the <br />City's efforts in providing public access. The Deputy Clerk indicated that <br />legislation is being proposed which would eliminate the City's franchising <br />authority and would also ~ive franchise fees to the State. The Deputy <br />Clerk pointed out that it is franchise fees that provides the revenue the <br />City uses to fund public access. <br />Mrs. Scalze introduced the followin~ resolution and moved its adoption: <br />
