MINUTES CITY COUNCIL DECEMBER 15, 1999 Fahey also indicated that he would like to know how other cities address auto sales lots. He noted that it has been awhile since the City has looked at this issue, and there may be other standards that should be considered. Fahey felt, however, that the variance needed to be denied. He further noted that an ordinance amendment would have to ~o throu~h the Plannin~ Commission for their review and comment. Morelan asked about compliance with the Zoning Administrator's recommendations. The Zoning Administrator noted that Valor Enterprises is the potential purchaser of the property. There are some code compliance issues that Valor Enterprises has agreed to do, and others that the current property owner Dan Sebesta has agreed to. The Zonin~; Administrator pointed out her report dated September 14, 1999 in the Council agenda that notes responsibility for compliance. Peterson asked for a reading on how the Council feels about the elimination of the distance separation requirement. Fahey replied that it appears there is an openness on the part of the Council to look at this standard. However, he does not have enough information this evening to say more than that. Pahey noted that a text amendment will be presented to the Planning Commission at their January l3`~' meeting, with a recommendation back to the Council at its January 26'~' meetin~. Morelan indicated that he is interested in finding a way to revise the code to make this situation work assumin~ that the solution will be fair for the rest of the community. Scalze indicated that she could not be sure of her position until she gets the recommendation from the Planning Commission. Fahey stated that he would like to see what other cities are doing. Scalze stated that she has no problem with the use in Ryan Industrial Park, however, was concerned about auto sales lots on Rice Street. Scalze noted that properties with an auto sales use generally to not pay a lot of property taxes.
