He noted that it has been awhile since the City has looked <br />at this issue, and there may be other standards that should be considered. <br />Fahey felt, however, that the variance needed to be denied. He further <br />noted that an ordinance amendment would have to ~o throu~h the <br />Plannin~ Commission for their review and comment. <br />Morelan asked about compliance with the Zoning Administrator's <br />recommendations. The Zoning Administrator noted that Valor Enterprises <br />is the potential purchaser of the property. There are some code <br />compliance issues that Valor Enterprises has agreed to do, and others that <br />the current property owner Dan Sebesta has agreed to. The Zonin~; <br />Administrator pointed out her report dated September 14, 1999 in the <br />Council agenda that notes responsibility for compliance. <br />Peterson asked for a reading on how the Council feels about the <br />elimination of the distance separation requirement. <br />Fahey replied that it appears there is an openness on the part of the <br />Council to look at this standard. However, he does not have enough <br />information this evening to say more than that. Pahey noted that a text <br />amendment will be presented to the Planning Commission at their January <br />l3`~' meeting, with a recommendation back to the Council at its January <br />26'~' meetin~. <br />Morelan indicated that he is interested in finding a way to revise the code <br />to make this situation work assumin~ that the solution will be fair for the <br />rest of the community. Scalze indicated that she could not be sure of her <br />position until she gets the recommendation from the Planning <br />Commission. Fahey stated that he would like to see what other cities are <br />doing. Scalze stated that she has no problem with the use in Ryan <br />Industrial Park, however, was concerned about auto sales lots on Rice <br />Street. Scalze noted that properties with an auto sales use generally to not <br />pay a lot of property taxes. <br />Morelan introduced the following resolution and moved its adoption: <br />RESOI.UTION NO. 99-12-260 - APPROVING A CONDITIONAI.
