MINUTES <br />CITY COUNCIL <br />DECEMBER 15, 1999 <br />The City Planner indicated that he concurred with the City Engineer's <br />recommendation for approval of the variance based on the same reasons as <br />outlined in the Engineer's report. <br />Morelan noted that the requirement that the developer provide <br />documentation of all necessary easements. The City Planner indicated <br />that he was concerned about the possible future construction of a cul-de- <br />sac at the end of the street. He noted that the developer is providing the <br />easement for the portion of the cul-de-sac on his property. Should MN <br />DOT cut off the loop portion of Viking Drive, it would be the <br />responsibility of MN DOT to negotiate with the property owners to obtain <br />the additional right-of-way for the cul-de-sac that would be required. <br />Morelan asked about enforcement of the Planner's recommendation that <br />the driveway for Lot l be located as far west as possible. The City <br />Administrator reported that the Building O~cial will enforce this <br />requirement at the time that a building permit is requested for the property. <br />Mr. Morelan introduced the followin~ resolution and moved its adoption: <br />RE.SOI. AS A VARIANCE <br />AI,I.OWING A 25 FOOT FRONT YARD SETI3ACK FOR I.OT 4 OF <br />THE PI.AT SUI3JECT TO COMPLIANCE WITFI THE <br />RECOMMENDATIONb' OF THE CITY ENGINEER, CITY <br />PI.ANNER, AND THE PLANNINC, COMMISSION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Fahey, LaValle, Pedersen. <br />Nays (0). Resolution dedared adopted. <br />REZONING - Fahey opened the Public Hearing to consider the rezoning of the <br />COUNTY Muel(er property on County Road B from Business Warehousing (BW) <br />ROAD B- to General Business (B-3) in order that a retail sporting goods business <br />MUELLER can be developed on the property. The Planning Commission has <br />PROPERTY recommended approval of the rezoning. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Fahey, seconded by LaValle, the public hearing was <br />closed. <br />
