MINUTES <br />CITY COUNCIL <br />JULY 99 2025 <br />most teenagers do not have. She stated that she has also become a lifeguard. She stated that she has <br />respect and thanks for Karen and Andrew, who have provided this opportunity to keep the kids rowing. <br />Mayor Fischer closed the public comment period. <br />Miller referenced the recommended condition of a one-year period and asked if that could be reflected <br />as March, which would allow review each March. The City Attorney explained that the City Code <br />states that a Special Home Occupation Permit can be issued for one year and then can be renewed for <br />periods of up to three years. Miller clarified that his intent would be to allow for this season with an <br />expiration in March, which would allow for review prior to the next season. The City Attorney <br />confirmed that could be done. <br />Kwapick stated that he is trying to weigh the balance between public access and private opportunity. <br />He recognized the concerns that had been expressed by neighbors related to noise and parking. He <br />stated that this process provides the opportunity to add conditions to make the situation tolerable for <br />everyone. He noted that if this is denied, the group could still go out on the lake with no conditions. <br />He explained that this process would allow for review to ensure the conditions are being followed, and <br />therefore, supports the request with the conditions. <br />Malone thanked the residents for the comments. She stated that for her, this comes down to a request <br />for a Special Home Occupation Permit. She noted that this activity is not within the home, and the <br />homeowners have nothing to do with the business; therefore, she believes that this permit request is <br />disqualified. She felt that they are trying to make this work for an outside, water -based business that <br />has already planted itself on the lake and is now trying to go through a city process that was never <br />meant for this type of scenario. She recognized the conditions that could be added, but recognized that <br />the city does not have jurisdiction over the lake. She stated that she is not against youth sports, but <br />believes there are other options open to the rowing club and did not believe this is the right fit for a <br />Special Home Occupation Permit. <br />Guiterrez commented that she did watch the last Council meeting as she was not in attendance. She <br />stated that she has seen several instances where something has come forward with people on opposite <br />sides, and in every instance, they have been able to find some kind of middle ground. She used the <br />example of a school being developed across the street from her property, noting that while it changed <br />the character of her neighborhood, she now appreciates the presence in the neighborhood. She stated <br />that she has been a Girl Scout leader for a long time, and it has never crossed her mind that she would <br />need special permission to have the Scouts in her yard doing an activity. She appreciated that the <br />homeowners/club came to the city with the request rather than just launching from the public launch, <br />as they would have the right to do. She commented that the lake is open to the public, and someone <br />does not have special use or ownership by living on the lakeshore property. She appreciated that the <br />club and homeowners were willing to agree to the conditions to make things easier for everyone. <br />Miller stated that the largest concerns that he has heard were related to parking and traffic, and he <br />wanted to ensure that they are doing everything they can to keep Edgerton safe. He recognized the <br />other concerns related to noise and the number of lanes and hoped that this would help to create <br />3 <br />
