MINUTES <br />CITY COUNCIL <br />JULY 992025 <br />Kwapick commented that there are good arguments on both sides and agreed that this is outside of the <br />box. He supported allowing people to make a good -faith effort to do their best, while being <br />reasonable. He recognized that it could be difficult to enforce, but wanted to provide the opportunity. <br />Malone stated that she does agree with Kwapick and Gutierrez on how this aligns with the desired <br />experience for residents and visitors, but still did not believe this is a home occupation. She <br />commented that the boats can be brought to the public access. She stated that the club could work with <br />a private business that has parking available and launch from the public access. <br />Guiterrez asked where there would be storage within the city. <br />Malone stated that Creative Catering has a large lot, but recognized that she has not spoken with that <br />business and just used that location as an example. <br />Mayor Fischer agreed that this is well beyond his comfort zone and what he would imagine to be a <br />home occupation permit. <br />Kwapick introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2025-7-103—APPROVINGA SPECIAL HOME OCCUPATION <br />PERMIT FOR 2612 EDGER TON STREET WITH THE CONDITIONS AS PRESENTED <br />Further discussion: The City Attorney commented that findings of fact would need to be <br />provided supporting the approval. <br />Kwapick stated that he does not believe that this activity inherently disrupts the residential <br />character of the neighborhood, as this is a lake community with lake activity. The proposed <br />conditions adequately address the community concerns and limit off -site impacts. While <br />different, two people living at the home are participants in the club. <br />Miller recognized that there was not a particular ordinance that this could be matched with. <br />The Community Development Director stated that the Special Home Occupation Permit allows <br />a broad deviation to account for these types of situations, such as dance classes or large engine <br />repair. He stated that this activity would not compete with the business district, and the home <br />occupation is focused on harmony with the existing neighborhood rather than regulation of <br />specific activity. <br />Mayor Fischer asked Kwapick to read in the recommended conditions. <br />Kwapick read the conditions presented in the staff report. <br />Miller referenced the second condition and asked that be amended to expire in March of 2026, <br />with the ability to renew each year. <br />5 <br />
