One garden shed is typically <br /> permitted as a part of the accessory building allowance on residential lots. <br /> In reviewing the ordinance after the meeting, however, it was confirmed that the <br /> issuance of a CUP for larger garage area creates a special condition under the following <br /> provision: <br /> 903.020.D.5. b. Conditional Use Permit. Beyond the limitations of Section 03.020.D.4. and <br /> 903.020.D.5 ofthis Ordinance, the construction of an additional garage structure, an <br /> additional accessory building, or an additional garden shed shall require the processing of a <br /> Conditional Use Permit subject to the provisions of Section 921 ofthis Ordinance. YVhen a <br /> Conditional Use Permit is issued to exceed oue thousand (1,000) square feet of garage <br /> and accessory building area, the parcel shall not be eligible for a detached garde~a shed <br /> as otherwise permitted by Section 903.020.D.S.a.(3) ofthis Ordinance. Any existing such <br /> sheds must be removed as a condition of the Conditional Use Permit. <br /> Under this clause, a condition of approval of the new CUP must be that the existing <br /> garden shed be removed. The intent of the amendment was to allow for the larger <br /> accessory building area on a parcel in exchange for less small building clutter on <br /> residential lots. <br /> This condition should be included with any approval of the CUP. <br /> <br />
