<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> OCTOER 21, 2009 <br /> The City Administrator reported that Mr. Peter Ganzel, 2795 Lakeside <br /> Court, has submitted an objection to the assessment of his property. The <br /> Administrator read the objection into the record, noting that the Mr. <br /> Ganzel does not believe that the assessment amount is equal to benefits <br /> received. <br /> The Mayor asked if there was anyone else present wishing to submit a <br /> written objection to the assessment. There was not. <br /> There was no one else present wishing to comment on the assessment for <br /> the Lakeside Court improvement. <br /> With regard to the Ganzel assessment appeal, the City Administrator <br /> reported that City has, in the past, obtained appraisal information as part of <br /> the assessment process. However, given that the City's Assessment Policy <br /> has been upheld, appraisals were not obtained for 2009 Improvements. <br /> An appraisal could be obtained, if the Council so desires. The <br /> Administrator noted that given the significant deterioration of Lakeside <br /> Court as well as the fact that there was no watermain on this street, it is <br /> staff's position that the improvement was necessary and the assessment <br /> levels are equal to benefits received. The City Administrator also noted <br /> that the assessment was applied uniformly among all classes of property in <br /> accordance with the City's Assessment Policy. <br /> Mr. Blesener introduced the following resolution and moved its adoption: <br /> RESOL UTION NO. 2009-IO-249 -DENYING THE PETER GANZEL <br /> ASSESSMENTAPPEAL, 2795 LAKESIDE COURT, FOR <br /> IMPROVEMENT NO. 2009-07, LAKESIDE COURT, BASED ON THE <br /> FOLLOWING: <br /> *THERE WAS NO WATERMAIN ON LAKESIDE COURT <br /> PROVIDING CITY WATER TO ABUTTING PROPERTIES; <br /> *THE STREET WAS IN SIGNIFICANT DETERIORATED <br /> CONDITIONAND REQUIRED REPLACEMENT; <br /> *THE CITY OF LITTLE CANADA FOLLOWED ITS STREET <br /> ASSESSMENT POLICYASSESSING IMPROVEMENT COSTS <br /> AGAINST BENEFITTING PROPERTIES; <br /> ^THE CITY'S ASSESSMENT POLICY HAS BEEN UPHELD <br /> AGAINST CHALLENGES IN DISTRICT COURT; <br /> 14 <br /> <br />
