MINUTIJS CITY COUNCIL OCTOER 21, 2009 * 4PPRAISERS HAVE DOCUMENTS THROUGH PAST APPLICATION OF THE CITY'S ASSESSMENT POLICY THAT BENEFITS RECEIVED ARE EQUAL TO OR GREATER THAN THE AMOUNT OFASSESSMENT GENERATED PURSUANT TO OUR POLICY; *ASSESSMENTS WERE APPLIED UNIFORMILYAGAINSTALL CLASSES OF PROPERTY; The foregoing resolution was duly seconded by McGraw. Ayes (4). Nays (0). Resolution declared adopted. Mr. Ganzel indicated that he had no comments at this time. The City Administrator reported that by submitting his objection, Mr. Ganzel has preserved his right to appeal the assessment in District Court. The Administrator also indicated that the City can obtain further documentation of the assessment meeting benefits received through an appraisal. Upon motion by Montour, seconded by Keis, the public hearing was closed. Mr. McGraw introduced the following resolution and moved its adoption: RESOLUTION NO. 2009-10-250 -ADOPTING THE ASSESSMENT ROLL FOR IMPROVEMENT NO. 2009-07, LAKESIDE COURT AS RECOMMENDED BY THE CITY ENGINEER The foregoing resolution was duly seconded by Blesener. Ayes (4). Nays (0). Resolution declared adopted. IMP. NO. Mayor Blesener opened the Public Igearing to consider the assessment oP 2009-14 - costs for the improvement of Brooks Avenue (from Arkwright to end) BROOKS & and Arkwright Street by road reconstruction, concrete curb and gutter, and ARKWRIGHT drainage enhancements. The Mayor indicated that there is a sign up sheet for residents with construction-related issues. Residents with those types of questions or concerns will be contacted following the meeting. The Mayor also noted that any property owners objecting to the assessment proposed for their property must submit a written objection this evening. The City Engineer reviewed the Brooks-Arkwright project cost details, indicating that estimated actual costs are $333,000.00, and of that amount $139,208.66 is being assessed.
