As a condition of PUD Amendment approval, the Permit will need to be <br /> amended to reference the current development proposal and any applicable conditions <br /> of approval. This issue should be subject to further comment by the City Attorney. <br /> Summary and Recommendation <br /> The proposed development is highly similar to that previously proposed by the <br /> applicant. Specific differences include the nature of the furniture store use (a standard <br /> HOM Furniture store with typical business hours verses a weekend clearance <br /> center/warehouse) and the appearance of the building. <br /> Based on the preceding review, our office recommends approval of the Planned Unit <br /> Development Permit Amendment, Comprehensive Sign Plan and Architectural Plans <br /> subject to the following conditions: <br /> 1. City Officials find the proposed furniture clearance center/warehouse use and <br /> associated weekend-only business hours to be acceptable. <br /> 2. The PUD Permit stipulate that the allowed retail uses are limited to the southern <br /> one third of the building (the area identified as "future showroom" on the site <br /> plan). <br /> 3. Seasonal outdoor sales activities be subject to the following requirements: <br /> A. Outdoor sales activities shall be limited to the area identified on the site plan. <br /> B. No more than six seasonal events/sales shall occur per calendar year. <br /> C. City Code requirements related to tent sales shall be satisfied. <br /> D. Seasonal outdoor sales shall not exceed 120 days per calendar year with no <br /> more than 60 of the days being non-banner and non-balloon events. <br /> E. Search lights and temporary signage shall be allowed subject to compliance <br /> with Section 903.110.4 of the Zoning Ordinance. <br /> 4. Consistent with previous approvals, the site plan be modified to depict a "proof of <br /> parking" area. <br /> 5. City Officials provide comment and recommendation regarding the proposed <br /> building appearance and specifically the proposed imitation loading docks. <br /> 6. The site plan and/or building elevations be modified to conceptually illustrate the <br /> proposed building expansion area. <br /> 5 <br /> <br />
