<br /> MINUTES <br /> CITY COUNCIL <br /> OCTOBER 28, 2009 <br /> found it to be acceptable. Therefore, the Planning Commission <br /> recommended approval. <br /> The City Administrator reported that Mr. Evans is ill and unable to attend <br /> this evening's meeting. The Administrator reported that there is currently <br /> a fire truck and trailer ou the property in violation of the ordinance. Mr. <br /> Evans was aware of this and has directed his tenant to have the truck acrd <br /> hailer removed within two weeks. <br /> Montour asked if each of the three tenants would be required to obtain an <br /> outdoor storage license. The Planner reported that the City's practice has <br /> been to require the property owner to obtain the licensing. There would be <br /> one license per property, and any violation of the license conditions puts <br /> all tenants in jeopardy. <br /> There was no one present wishing to comment on this matter. <br /> Upon motion by McGraw, seconded by Montour, the public hearing was <br /> closed. <br /> Mr. McGraw introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2009-I0-255 -APPROVING THE <br /> CONDITIONAL USE PERMITALLOWING OUTDOOR STORAGE <br /> AT 182 RYAN DRIVE AS REQUESTED BY DAVE EVANS SUBJECT <br /> TO COMPLIANCE WITH THE RECOMMENDATIONS OF THE <br /> CITY PLANNER AND THE PLANNING COMMISSION AND <br /> SUBJECT TO REMOVAL OF THE FIRE TRUCKAND TRAILER <br /> WITHIN TWO WEEKS FROM TODAY <br /> The foregoing resolution was duly seconded by Boss. <br /> Ayes (5). <br /> Nays (0). Resolution declared adopted. <br /> CUP I+OR Mayor Blesener opened the public hearing to consider the request of Tom <br /> COMP. SIGN Duray for a Conditional Use Permit for a Comprehensive Sign Plan as <br /> PLAN & well as a Variance to allow the repair and expansion of the existing <br /> VARIANCE non-conforming pylon sign base to encroach farther into the required <br /> FOR SIGN setback at 2526 Rice Street. The Mayor noted that the City Planner and <br /> LOCATION - the Planning Commission recommended approval. <br /> 2526 RICE <br /> STREET - The City Planner reported that the CUP for Comprehensive Sign Plan is <br /> TOM DURAY related to the fact that this is a muhi-tenant building. The Variance is to <br /> allow additional encroachment of the pylon sign into the required setback. <br /> The Plainer noted that with regard to the Comprehensive Sign Plan, the <br /> signage as proposed meets Code requirements.
