However, <br /> either way, the total signage square footage meets the code. The Planner <br /> noted that his report refers to 66 feet of signage being allowed for the <br /> pylon sign, when the maximum allowed is actually 77 square feet. The <br /> pylon as proposed is C3 squa~~e feet, well below the maximum allowed. <br /> The Planner noted that in recommending approval of the Variance, the <br /> Planning Commission identified findings that justify the Variance. These <br /> findings include that there is no other reasonable location for the pylon <br /> sign due to the location of the Magellan Pipeline Easement, relocation to <br /> the north end of the property would interfere with the signage of the <br /> adjacent property, and relocation further north near the Rice Street <br /> entrance would pose traffic safety concerns. The Planner also noted that <br /> Magellan has indicated that they would not support the relocation of the <br /> pylon sign within their easement due to the location of three underground <br /> pipes very close to the pylon. The Planner also noted that the applicant is <br /> bringing the pylon more into conformance with the Code, reducing the <br /> height to the 16 foot maximum and improving the architectural appearance <br /> of the sign. <br /> Bleseuer asked the setback of the pylon. The Planner replied that the <br /> pylon is about''/2 foot from the Demont Avenue right-of-way line and 2.3 <br /> feet from Rice Street. The Code required a 5 foot setback from each right- <br /> of-way, and this setbac]< applied to all components of the sign. <br /> Tom Duray, property owner of 2526 Rice Street, appeared before the <br /> Council reviewing the property in detail, his leasing of the building to <br /> ASAP Signs as well as Papa Murphy's, and his signage and variance <br /> requests. Duray reported that the existing pylon sign was damaged <br /> approximately 7 years ago, and he reviewed an affidavit submitted by <br /> Greg'Truhler, ASAP Signs, to that effect. Duray indicated that when he <br /> purchased the property, he had the pylon straightened and rather than <br /> repair the cracked concrete base as it existed, he had it repaired and a brick <br /> enclosure added around the base. The brick matches the brick used on the <br /> building and brings the sign closer into compliance with the City's <br /> Architectural Guidelines. However, the brick enclosure also encroaches <br /> further into the required setback for the sign by the width of the brick <br /> itself. <br /> Duray indicated that when it was discovered that the pylon did not meet <br /> setback requirements, he looked at options to relocate the sign on the <br /> property. He then found that there is a Magellan pipeline easement <br /> through the south 35 feet of the lot that has existed since 1931. This <br /> easement actually covers ll3 of the lot Magellan has indicated that there <br /> are three pipelines just north of the pylon sign. These pipes are <br /> approximately 4 feet deep. 'Therefore, Magellan is very concerned about <br /> moving the pylon sign. Duray reported that he obtained an encroachment <br /> 3 <br /> <br />
