<br /> MINUTES <br /> CITY COUNCIL <br /> OCTOBF,R 28, 2009 <br /> ¦ The property has been continually non-compliant with the agreed <br /> upon condition of no junk, debris, and other materials not <br /> approved, shall not he stored in the designated storage areas. <br /> The property has non-compliant outdoor storage. Minnesota <br /> Asphalt acid Vision Tree Service have outside storage of <br /> equipment and materials that is not approved. <br /> ¦ Required paving, striping, and curbing has not been installed on <br /> the required 24 parking spaces. <br /> Outdoor storage is occurring outside of designated areas. <br /> ¦ The property has not installed the required screening on the <br /> approved-designated storage areas. <br /> Vision Tree Service has been established as an illegal tenant in that <br /> they are not depicted on the PUD Permit, they occupy no building <br /> space, and their equipment is stored in unapproved areas. <br /> ¦ The paving company is illegally established due to outdoor storage <br /> of equipment and materials that are viewed as legal if they occupy <br /> building space and all materials and equipment are stored inside. <br /> Mr. Kenneth Schivone, attorney representing Mary Fasching, reported that <br /> he attended the Plvu~ing Commission with Ms. Fasching last July and <br /> they came away with the understanding that they had until November 30, <br /> 2009 to bring the property into compliance. Schivone stated that it was <br /> unclear to Ms. Fasching that it was necessary for her to attend the .iuly 22, <br /> 2009 City Council meeting. Schivone stated that he has not looked into <br /> the various notices that Ms. Fasching received, and indicated that he was <br /> just contacted this afternoon and asked to attend tonight's meeting. <br /> Schivone stated that it is his understanding that the property owners are <br /> undertaking repairs to bring the property into compliance. They have <br /> given notice to Vision Tree to vacate the property. Schivone stated that it <br /> was their impression that they had until November 30°i to bring the <br /> property into compliance. <br /> Mary Fasching presented two site plan amendments that they had been <br /> working on relative to a PUD amendment, noting that one was part of the <br /> application for an amended PUD. These plans show the removal of <br /> parking along Ryan Drive. Fasching pointed out that Vision Tree was <br /> parked along the fence and they will be vacating the property November <br /> 30`x'. Fasching stated that they are working with MN Asphalt on <br /> compliance issues and noted that they have been a tenant for the past ] 0 <br /> years. <br /> Blesener pointed out that it appears a lot of the equipment has not moved <br /> in 10 years. Keis reported that he visited the property today and finds it <br /> hard to believe that it would be possible to bring it into compliance by <br /> November 3011'. Fasching stated that they will get the work done, but have <br /> issues with parking. Keis indicated that there are more than just parking <br /> 9 <br /> <br />
