<br /> MINUTES <br /> CITY COUNCIL <br /> OCTOBER 28, 2009 <br /> 1'he Administrator then reviewed a list of meetings with the property <br /> owners, letters sent to the property owners, and citations issued to the <br /> property owners. The Administrator noted that the property owner has <br /> been cited recently on three occasions for code violations -May, 2007, <br /> August, 2008, and September, 2008. He pointed out that the property <br /> owners made application on May 18, 2009 for an amendment to thou PUD <br /> Permit which was the court date for the citations. The Administrator felt <br /> that the application was made to show the courC that the properly owners <br /> were trying to resolve their violations. <br /> The Administrator then reviewed the processing of the 2009 PiJD <br /> Amendment application, noting that the Planning Commission <br /> recommended approval of the revised PUD (subject to the new ordinance <br /> requirements) on July 9, 2009, and further recommended if the property <br /> owner decided not to go forward with the revisions, compliance with Che <br /> existing PUD should be achieved by November 30, 2009. The PUD <br /> application was then reviewed by the City Council on July 22, 2009. 'fhe <br /> Council denied the application for a revised PUD Permit. The property <br /> owners did not appear at the .Tuly 22"d meeting, thus the Council gave <br /> them until the nexC regular Council meeting (August 12, 2009) to appeal <br /> Their decision. That was communicated to the property owner in writing <br /> and by a telephone call. <br /> The Administrator noted that the staff report submitted to the Council in <br /> July recommends that should the Council deny the amended PUD request, <br /> the property owner have 90 days to bring the property into compliance. <br /> The 90 days expired on October 22, 2009. The property owner had been <br /> provided with a copy of dre staff's report which was dated in June of <br /> 2009; so essentially, the property owner was given 120 days notice of this <br /> recommendation given the tabling of action on Chis matter. The <br /> Administrator also reportod that staff sent a letter to the property owner on <br /> October 5, 2009 reminding them of the October 22"d compliance deadline. <br /> "the City Administrator reported that Vision Tree called and informed City <br /> staff that the property owner gave them 60 days notice to vacate the <br /> property. Vision Tree confirmed that the property owner had the notices <br /> That were just mentioned, as the property owner informed Vision Tree of <br /> the City's actions. <br /> The City Administrator indicated that based on this information, City staff <br /> is recommending that the PUD Permit for 3151 Country Drive be revoked <br /> based on the following findings of fact: <br /> There has been failure to comply with the requirements of the <br /> Planned Unit Development Permit approvals by the designated <br /> deadline of October 20, 2009. <br /> 8 <br /> <br />
