Resolution declared adopted. <br /> ORDER OF The City Administrator reviewed his report dated December 9, 2009 <br /> ABATEMENT relative to City staff s long standing attempt to work with the <br /> UNSAFE property owners of 2894 Vanderbie Street to complete the construction <br /> BUILDING- of an addition on their house. These efforts have not been successful. <br /> 2894 The property owners have been occupying the addition without a <br /> VANDERBIE Certificate of Occupancy. The Administrator noted that the major <br /> STREET outstanding issues is that there are no egress windows in the basement <br /> bedrooms, the concrete floor has not been poured in the basement, and <br /> mechanical permits have not been issued for the wood burning <br /> supplemental heating source. <br /> The City Administrator reported that staff is proposing that an Order of <br /> Abatement be issued for the building. This Order will give the property <br /> owners until January 15, 2010 to complete the necessary work <br /> appropriately, have it inspected, and a Certificate of Occupancy issued. 1f <br /> that deadline is not met, the City will petition the Court to allow the City <br /> to have the work done and assess it against the property. <br /> Keis expressed concern that given the holidays, January 15, 2010 was not <br /> a reasonable time period for the property owner to get this work done. <br /> The City Administrator indicated that if the property owner is working <br /> toward completion, the City can amend the order to given them additional <br /> time. <br /> The City Attorney noted that the Building Official sent the property <br /> owners a letter in April relative to the need to get the work completed. <br /> The Order of Abatement is the last step in the process to get this work <br /> done. If the property owners does not meet the deadline or agree to an <br /> amended deadline with the City, the Court will issue the order allowing <br /> the City to get the work done. The City will then be able to put the cost of <br /> the work on property taxes to be collected over a one year period. The <br /> City Attorney indicated that another outcome would be to reach a <br /> 17 <br /> <br />
