<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> DECEMBER 16, 2009 <br /> The City Administrator reported that the property owner has made fairly <br /> substantial progress cleaning up the site, but violations still exist. The <br /> Administrator felt that the lack of compliance is indicative of continuing <br /> violations that have existed for many years. He noted that staff has <br /> recommended revocation of the PLJD Permit for this property based on a <br /> listing of findings, and staff's recommendation still stands given the long <br /> history of violations and failure to achieve compliance as of today's date. <br /> Keis asked about relocation of the cyclone fence that is in the right-of <br /> way. The Administrator reported that the fence has not yet been moved. <br /> The fence has existed in its current location for a number of years, and the <br /> Administrator reported that there is no evidence in the file that a building <br /> permit was issued for this fence. Mary Fasching, property owner, reported <br /> that she is obtaining a survey of the property to determine where the fence <br /> needs to be moved to. That work will be done by the end of June. <br /> With regard to the condition of the property, Fasching reported that they <br /> have been working to clean up the site, but have met with a few obstacles <br /> which have delayed a total cleanup. Those obstacles are a lack of <br /> materials as well as the cost. Fasching reported That additional siding has <br /> been ordered to complete the enclosure of the cold storage building. <br /> Fasching indicated that the cold storage building would remain as such <br /> and a concrete floor would not be added. The truck that is currently in the <br /> building will be removed. A 12' by 12' garage door will be installed on <br /> this building. <br /> Montour asked what will be stored in this building. Fasching replied that <br /> materials will be stored, and she understands that vehicles cannot be in the <br /> building. With regard to other compliance issues, Fasching reported that <br /> the two inoperable vehicles will be removed from the property the week <br /> after Christmas. Parking on the site is adequate at 25 stalls and curb cuts <br /> have been installed. Fasching stated that in meeting with City staff it was <br /> her understanding that any truck under aone-ton is allowed on the site. <br /> The larger vehicles have been removed from this property. Fasching <br /> stated that she is contacting the rubbish company to get the two dumpsters <br /> moved to within the screened area. The wood screening fence will be <br /> completed and Fasching reported that they are waiting for some additional <br /> hinges for the gates. <br /> Fasching reported that clean up of the site has taken longer than expected. <br /> One outstanding issue is that of MN Asphalt and the need to amend the <br /> PUD Permit to include this business use. Fasching indicated that she <br /> would contact City staff relative to the process for amending the PUD. <br /> T'he City Administrator noted that MN Asphalt is not an approved user <br /> under the existing PUD Permit, and pointed out that the revised outdoor <br /> 6 <br /> <br />
