MINUTES PLANNING COMMISSION JANUARY 14, 2010 The City Plam7er indicated that the biggest issue would be determining jurisdiction city-to-city on such issues as code enforcement, utility services, taxing, etc. Pechmann asked for about proposed ponding, rain water gardens, etc. Molstad indicated that the rain water garden is proposed on Outiot B. He indicated that there are a couple of catch basins in the street that water will run into before beuig diverted to the rain water garden. He then described how the pond would function with overflow directed into another rain water garden to the southwest Molstad reported that drainage for the entire site flows from LaBore Road mainly to the south and southeast, with a small portion to the southwest. Fischer asked about maintenance of the outlots, and whether there would be a homeowners association. Fair reported that the maintenance of rain water gardens is currently in discussion with the City Administrator and should be resolved within a couple of weeks. There will be a homeowners association which will be responsible for maintaining the monument sign and adjacent landscapingjust off LaBore Road. Pechmann asked how will maintain the grass on Outlots A and B, noting that these are large parcels. Fair again indicated that this is in discussion with the City Administrator. At this point the meeting was opened to comments from the general public. Dave hIinnnelbach, 2970 LaBore Road, the parcel immediately east of proposed Gervais Woods, appeared before the Commission. Himmelbach reported that he has been in previous communication with the City relative to his property being an archeological site. Himmelbach reported that he has fowrd artifacts on his property which he needs to bring to the State's archeologist. He feels that once these artifacts are evaluated, the State archeologist will want an archeological survey done of the property. Himmelbach repoi•Ced that the artifacts were found in the location of where the stub road would extend to the east Himmelbach felt that, as a result, the extension of this stub road may not be permissible. Duray noted that Himmelbach brought up this issue two years ago, and suggested that he expedite his assertions with the State archeologist given the timing of the Gervais Woods plat Himmelbach stated that had he been prompt the archeological survey would likely be in the wor]<s. Pechmann asked if any progress had been made at the initial point of discovery of the artifacts or did the issue not move forward. Pechmann reported that he recalled the issue as previously raised by Mr. Himmelbach in relation to the proposed Richie Place development. The City Planner indicated that Mr. Fimmelbach was to provide the information he had, so it could be followed up on. That was not done. -4-
