<br /> MINUTES <br /> <br /> PLANNING COMMISSION <br /> <br /> JANUARY 14, 2010 <br /> The City Plam7er indicated that the biggest issue would be determining <br /> jurisdiction city-to-city on such issues as code enforcement, utility <br /> services, taxing, etc. <br /> Pechmann asked for about proposed ponding, rain water gardens, etc. <br /> Molstad indicated that the rain water garden is proposed on Outiot B. He <br /> indicated that there are a couple of catch basins in the street that water will <br /> run into before beuig diverted to the rain water garden. He then described <br /> how the pond would function with overflow directed into another rain <br /> water garden to the southwest Molstad reported that drainage for the <br /> entire site flows from LaBore Road mainly to the south and southeast, <br /> with a small portion to the southwest. <br /> Fischer asked about maintenance of the outlots, and whether there would <br /> be a homeowners association. Fair reported that the maintenance of rain <br /> water gardens is currently in discussion with the City Administrator and <br /> should be resolved within a couple of weeks. There will be a homeowners <br /> association which will be responsible for maintaining the monument sign <br /> and adjacent landscapingjust off LaBore Road. Pechmann asked how will <br /> maintain the grass on Outlots A and B, noting that these are large parcels. <br /> Fair again indicated that this is in discussion with the City Administrator. <br /> At this point the meeting was opened to comments from the general <br /> public. <br /> Dave hIinnnelbach, 2970 LaBore Road, the parcel immediately east of <br /> proposed Gervais Woods, appeared before the Commission. Himmelbach <br /> reported that he has been in previous communication with the City relative <br /> to his property being an archeological site. Himmelbach reported that he <br /> has fowrd artifacts on his property which he needs to bring to the State's <br /> archeologist. He feels that once these artifacts are evaluated, the State <br /> archeologist will want an archeological survey done of the property. <br /> Himmelbach repoi•Ced that the artifacts were found in the location of where <br /> the stub road would extend to the east Himmelbach felt that, as a result, <br /> the extension of this stub road may not be permissible. <br /> Duray noted that Himmelbach brought up this issue two years ago, and <br /> suggested that he expedite his assertions with the State archeologist given <br /> the timing of the Gervais Woods plat Himmelbach stated that had he <br /> been prompt the archeological survey would likely be in the wor]<s. <br /> Pechmann asked if any progress had been made at the initial point of <br /> discovery of the artifacts or did the issue not move forward. Pechmann <br /> reported that he recalled the issue as previously raised by Mr. Himmelbach <br /> in relation to the proposed Richie Place development. The City Planner <br /> indicated that Mr. Fimmelbach was to provide the information he had, so <br /> it could be followed up on. That was not done. <br /> -4- <br /> <br />
