RETAINER AGREEMENT <br /> This Retainer Agreement (hereinafter "Agreement") is entered into this day of <br /> 2010 ("l~ffeetive Date") by and between ("Hearing <br /> Officer") and the City of Little Canada ("City"). <br /> 1.0 PURPOSE <br /> "T'he City contracts with the Ramsey County Sheriff's Department ("Department") to <br /> provide law enforcement services iu the City. "1'he Department provides similar services <br /> to seven municipalities in Ramsey County, Minnesota, including Little Canada. l;ach of <br /> the municipalities, including I,itt3e Canada, has or wilt soon authorize the Department to <br /> issue adminisri•ative citations for certain traffic offenses, as recently authorized by the <br /> Legislature in Minnesota Statutes, § 169.999. The statute requires local governments to <br /> provide for a neutral, independent and impartial hearing of any issued citation, if <br /> requested by a cited driver. The seven municipalities have requested that the Department <br /> administer the administrative citations program centrally for all participating cities. Little <br /> Canada, as one of the participating cities, has reached agreement with the I-Iearing Officer <br /> to provide the neutral independent and impartial hearings required by law for all citations <br /> written by the Department. This Agreement provides the terms and conditions under <br /> which I-Iearing Officer shall provide such services to tlie public, the Department and the <br /> municipalities to which the Department provides trafPie patrol services, by serving as an <br /> impartial hearing officer for the administrative traffic citations issued in the <br /> municipalities served by the Department. <br /> 2.0 DEFINITIONS <br /> The following terms used in the Agreement shall have the meanings given below: <br /> Citation. An administrative citation issued to a motorist foz• a traffic offense, as specified <br /> by Minnesota Statutes~~' 169.999, occurring within the Department's area of patrol. <br /> Issuing Officer. T'he licensed peace officer employed by the Department who issues any <br /> particular administrative citation. <br /> ReciUient. The person who receives au administrative citation issued by the Department. <br /> 3.0 SCOPE OF WORK <br /> 3.1 Administration of Hearings <br /> The Hearing Officer shall receive assigmnents of cases for hearing from the <br /> Department's staff administering the administrative traffic citations program.
