<br /> MINUTES <br /> CITY COUNCIL <br /> FEBRUARY 24, 2010 <br /> to meet with City staff within 30 days to report on the status of the <br /> property. The Council also suggested that the property owners work on <br /> several of the easy items that need to be corrected prior to the 30-day <br /> meeting. <br /> The Administrator reported that the property owners have not contacted <br /> nor met with City staff since the December 16t~' meeting. The <br /> Administrator reported that some of the violations have been addressed <br /> since December I6`~', but the following still exist: <br /> Floor of the storage building remains a dirt floor; therefore, the <br /> truck being stored in the building is not allowed; <br /> Outdoor storage of equipment exists in unapproved locations; <br /> Debris stored along side the building; <br /> Outdoor storage along side the building is not screened; <br /> Outdoor storage in front of the screening fence; <br /> Vehicles in unapproved locations and these vehicles appear to be <br /> inoperable; <br /> Outdoor storage area on the side of the building is not screened. <br /> Mary Fasching reported that they had intentions of being in full <br /> compliance, however, due to weather and other factors were not able to do <br /> so. She reported that they are very discouraged about the situation with <br /> their tenants, and feel they are being discriminated against. Fasching <br /> reported that they have lost about 2/3rds of their rental income and are <br /> barely making enough to cover their property taxes. Fasching reported <br /> that one of their tenants, MN Asphalt, came to the City to try to work <br /> something out and left upset when the City told them they would not work <br /> with them to resolve the issue of parking of their trucks and equipment. <br /> Fasching reported that they have owned this property for over 20 years <br /> and feel that their uses should be grandfathered in. Fasching pointed out <br /> that the ordinances keep changing. She noted that this is industrial <br /> property, but was not sure what type of business could go into the <br /> location. Fasching also pointed out the difficulty of utilizing this property <br /> given its shape and building location. <br /> Fasching presented a series of pictures showing outdoor storage, etc. on <br /> neighboring properties. She pointed out dumpsters and trucks that were <br /> outside of screened areas and questioned why she was required to screen <br /> dumpsters and trucks when others were not. Fasching asked why the City <br /> will not work with them to allow MN Asphalt to park their trucks and <br /> equipment on the property. <br /> Keis noted that ten years ago the City issues a PiJD Permit for this <br /> property and the property owners, Mr. Costanzo and Ms. Fasching, have <br /> 2 <br /> <br />
