<br /> MINUTES <br /> CITY COUNCIL <br /> <br /> FEBRUARY 24, 2010 <br /> speaks with the City Administrator and the Code Enforcement officer, <br /> things change. <br /> McGraw indicated that it was his understanding that Faschin~ was to have <br /> a meeting with City staff within 30 days of the December 16" meeting. <br /> This was not done, nor was there any indication that it would be MN <br /> Asphalt that would be sent in to have that meeting with staff. Fasching <br /> indicated that the City Administrator indicated that he would work with <br /> MN Asphalt on a plan. Fasching stated that she was not aware that MN <br /> Asphalt was coming in to talk to City staff until after the meeting had <br /> occurred. <br /> The City Administrator stated that it was his recollection that MN Asphalt <br /> was frush•ated that the current PUD Permit did not list them as an <br /> approved outdoor storage user. To modify the PUD Permit would require <br /> an amendment. The Administrator indicated that modifying the PUD <br /> Permit is not impossible, but creates a new set of frustrations as the current <br /> Code will have to be complied with. <br /> Costanzo again expressed his frustration. He indicated that he does not <br /> have public coming to the property, therefore has no need of public <br /> parking spaces. Costanzo indicated that when the property was developed <br /> it was designed to accommodate industrial tractors and combines. The <br /> property was always full of this type of equipment. Costanzo reported that <br /> when he purchased the property from Peterson Maintenance, he pulled 52 <br /> truck loads of roofing from this site. Costanzo indicated that at the time <br /> he purchased the property the City Administrator indicated that every <br /> thing was OK. Six months later he wanted to put in a frame rack system <br /> and the City Administrator said that was fne and then made them take it <br /> down. Costanzo indicated that he would never have purchased the <br /> property had he know this. Therefore, he began to rent the property out. <br /> Costanzo felt his use of the property should be grandfathered in. He stated <br /> that he wants to keep MN Asphalt as renters. Costanzo felt it was the City <br /> Administrator's job to work with MN Asphalt, and indicated that the <br /> Administrator just sent them away. <br /> The City Administrator reported on the history of the Costanzo/Fasching <br /> property back to 1999, noting the issuance of a P1JD Permit for outdoor <br /> storage of roofing and electrical supplies and the attempts to get this <br /> property into conformance with the Code. The Administrator noted that <br /> the 1999 planning report requires a wooden fence be established to screen <br /> each storage area, and that the lean-to building have doors to screen the <br /> interior storage from view from the street. The Administrator noted that <br /> this was a condition of the 2000 PUD Permit and these requirements are <br /> just now being met.
