<br /> MINUTES <br /> CITY COUNCIL <br /> FEBRUARY 24, 2010 <br /> Fasching indicated that they have every intention of resolving the <br /> outstanding code items. However, they would like the City to work with <br /> them to allow MN Asphalt to remain on the property. Costanzo indicated <br /> that this is what they are asking for. Fasching reported that MN Asphalt <br /> will store their larger equipment off-site. <br /> Montour indicated that the property must comply with the rules that are in <br /> place and again noted the work the City has done with the Ryan Industrial <br /> Park property owners. <br /> Costanzo stated that if this is a matter of money, he would pay the City. <br /> Costanzo asked how other properties are able to store the same type of <br /> equipment as he is asking for. The City Administrator indicated that he is <br /> not sure whether the properties referenced by Costanzo are in compliance. <br /> Costanzo again stated that the City Administrator is coming after him <br /> viciously. <br /> Montour pointed out that this is not the only property on which the City is <br /> trying to get compliance. <br /> Fasching pointed out the tanker truck on the property next door. Costanzo <br /> stated that he has always done what City staff has asked, but felt the City <br /> Administrator could not be trusted. The City Administrator indicated that <br /> the Costanzo property has never been in compliance. <br /> Fasching felt that a mediator was needed to work out this situation. She <br /> indicated that each time they meet with staff, they are given different <br /> information and things keep changing. Costanzo noted that the cold <br /> storage building is not a building, but clean-to and was constructed as a <br /> lean-to. Costanzo indicated that the City designed the structure as a lean- <br /> to. McGraw clarified that the City did not design the building. Costanzo <br /> agreed, but indicated that the City approved its construction and collected <br /> money for the building permit. <br /> Keis pointed out that this issue of PUD Permit compliance has been going <br /> on on this property for ten years. He noted the meetings held during 2009 <br /> and the fact that this is the first one Costanzo has attended. Keis noted <br /> that over the past year plans were laid out, deadlines set, and compliance <br /> has not been achieved. McGraw agreed and noted that at the December <br /> 16°i meeting Ms. Fasching was given an additional 60 days to achieve <br /> compliance on the property. McGraw asked if Fasching ever contacted <br /> the City to inform them that it would be difffcult to achieve compliance in <br /> the 60 days due to weather, etc. Fasching replied that she did not although <br /> she thought compliance would be achieved. McGraw asked if in hindsight <br /> Fasching would have called. Fasching replied that she would have if it <br /> would have changed anything.
