<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> MARCH 8, 2010 <br /> Nays (0). Resolution declared adopted. <br /> PUBLIC The City Administrator reported that based on the Council's direction <br /> COMMENT staff put a draft Public Comment Rules for utilization during Council <br /> RULES meetings. These rules are based on information and samples obtained <br /> from the League of Mimiesota cities and have been drafted to rt the Little <br /> Canada Council's style. The Administrator asked the Council for their <br /> comments relative to this draft policy. <br /> Keis felt that the policy got the Council to where it wants to be without <br /> drafting an ordinance. Montour indicated that it is not the Council's intent <br /> to restrict anyone's opportunity to speak at a Council meeting, but rather <br /> to have guidelines in place in the event they are needed. Keis felt the <br /> policy helped people know the City's expectations. 'The Administrator <br /> indicated that the policy would be available at all Council meetings. <br /> Mr. Keis introduced the following resolution and moved its adoption: <br /> RESOL UTION N0.2010-3-SI -ADOPTING THE PUBLIC <br /> COMMENT RULES AS PRESENTED BY CITY STAFF <br /> The foregoing resolution was duly seconded by Boss. <br /> Ayes (4). <br /> Nays (0). Resolution declared adopted. <br /> OFFER OF The City Administrator reviewed his report dated March 5, 2010 <br /> JUST outlining the need to acquire road right-of--way and utility easements <br /> COMPF.N- to facilitate the Northeast Utility Extension Project. The Administrator <br /> SATION - noted that this project is possible given our previous project with the City <br /> HIMMELBACH of Maplewood two year's ago that extended water and sewer in the <br /> Kohlman Lane/Beam Avenue area. <br /> AND The Northeast Utility Extension Project will bring utilities to serve the <br /> BATTISTA Gervais Woods project which will come before the Council at its next <br /> meeting for Final Plat approval as well as future development of the <br /> Himmelbach, Battista, and Sculley properties. The project will avoid the <br /> need for future lift stations as these properties develop. <br /> The Administrator reported that the issue before the Council is to <br /> authorize offers of just compensation for the right-of-way and easement <br /> areas needed from the Himrnelbach and Battista properties. The <br /> Administrator indicated that the offers are based on appraisals of the <br /> property. The Administrator indicated that if the offers are not accepted <br /> by the property owner, then the City's next step would be to proceed with <br /> eminent domain. <br /> 3 <br /> <br />
