Gervais Woods <br /> Development Contract <br /> Gervais Woods. Ramsey County shall maintain that property in a manner consistent with the <br /> other "open space" they own in the immediate area. <br /> 33. The Developer shall dedicate the east 20 feet of Lot 1, Block 2 as an easement for <br /> trail purposes as part of the platting process. This shall be in addition to the standard "per lot" <br /> park charge fees. <br /> 34. The Developer shall expand the storm water pond located on the south portion of <br /> Lots 1-3, Block 2 to accommodate the drainage needs of potential development associated with <br /> the combination of Outlot B and portions of the Quam property. To facilitate the expansion of <br /> the pond, Developer shall transfer ownership in Outlot D to Ramsey County in exchange for the <br /> land labeled as "Outlot E" on the Attachment E. The Developer shall be responsible for all <br /> costs, including those incurred by the Developer, Ramsey County, and the City, associated with <br /> this transfer of ownership including, but not limited to, survey, title search, legal, notification, <br /> publication, and recording fees. The City shall coordinate this process with Ramsey County and <br /> cooperate with the Developer to complete this process as soon as practical. The City, in <br /> recognition of the additional costs incurred by Developer shall reimburse Developer for these <br /> costs an amount not to exceed $25,000, and then specially assess them to Outlot B. The amount <br /> to be reimbursed and assess shall be based on documented costs incurred associated with <br /> oversizing the pond and storm sewer system as well as costs associated with the land transfer <br /> involving Ramsey County and tree replacement costs with the City of Maplewood with the final <br /> determination of to be made at the City's sole discretion. Concurrently with the execution of this <br /> document, Developer shall also execute a Waiver of the Right to Contest Special Assessments as <br /> indicated in Attachment F. <br /> 35. Developer shall comply with all Maplewood plat approval conditions. <br /> 36. Developer shall include definitive statements in all sales literature regarding <br /> future development off of each end of Woodland Drive. It should be made clear that the east <br /> portion of Woodlyn Drive will ultimately connect to Kohlman Lane. The purpose of these <br /> 3~ <br /> <br /> ro <br /> <br />
