Gervais Woods Development Contract statements is to make prospective buyers aware of likely development in order to minimize objections in the fixture. Developer acknowledges that a lift station connecting the development to LaBore Road would have been necessary if the City did not provide a connecting line from the Kohlman Lane/Beam Avenue area to the east line of Woodland Drive. In lieu of constructing a lift station to serve the development, Developer shall remit to the City One hundred ten thousand dollars ($110,000) as an offset to the lift station costs to reimburse the City for costs incurred in making a gravity flow line available to Gervais Woods. Seventy thousand ($70,000) shall be due within sixty (60) days of execution of this agreement, or if specially assessed, Developer shall pay off this amount within 30 days of adoption of the special assessment. Failure to do so will result in a draw of the Letter of Credit referenced in Provision #11. The balance of Forty Thousand ($40,000) shall be specially assessed against Outlot B of Gervais Woods. Concurrently with the execution of this document, Developer shall also execute a Waiver of the Right to Contest Special Assessments as indicated in Attachment F. Developer also acknowledges that City reserves the right to modify the amount of assessment for the components listed in Provision #'s & 36 to enable the equitable treatment of other properties that may also be benefitted by the sanitary sewer trunk line. 37.
