Resolution declared adopted. <br /> The City Administrator reviewed the proposed Development Agreement <br /> for Gervais Woods, summarizing some changes relative to the property <br /> swap between the developer and Ramsey County, the potential assessment <br /> and deferment of assessment of Outlot I3 for sanitary sewer service as well <br /> as other issues related to the sanitary sewer improvement, the ability of the <br /> developer to construct three model homes, and the City's providing the <br /> sanitary sewer line by October ls'. The City Administrator reported that <br /> the Development Agreement should be subject to final review and <br /> approval of the City Attorney. <br /> Mr. McGraw inri~odueed the following resolution and moved its adoption: <br /> RESOLUTIONNO. 2010-3-61-APPROVING THE GERVAIS <br /> WOODS DEVELOPMENT AGREEMENT AS OUTLINED BY THE <br /> CITYADMINISTRATOR, SUBJECT TO REVIEW AND APPROVAL <br /> BY THE CITY ATTORNEY, AND A UTHORIZING THE MAYOR AND <br /> CITYADMINISTRATOR TO EXECUTE THEAGREEMENT ON <br /> BEHALF OF THE CITY <br /> The foregoing resolution was duly seconded by Montour. <br /> Ayes (4). <br /> Nays (0). Resolution declared adopted. <br /> 3751 COUNTRY Acting Mayor Montour brought back from table the Public Hearing to <br /> DI3IVI: - consider the revocation of PtJD Permit for outdoor storage for 3151 <br /> COSTANZO Cowrtry Drive owned by Tony Costanzo and Mary Fasching. <br /> PUD <br /> REVOCATION The City Administrator reported that Council representatives and City <br /> staff held two meetings with the property owners of 3151 Country Drive <br /> to discuss the outstanding issues and option available for amending the <br /> PIJD Permit. City staff proposed some workable concepts to the property <br /> <br /> ' owners. The Adminisriā€¢ator reported that this afternoon Ms. Fasching <br /> delivered a letter which indicated that they have decided not to seek an <br /> amendment to their PUD Permit and will abide by the existing PUD <br /> Permit.
