Montour felt that if that were <br /> the case there would have been a lot of other people involved in evaluating <br /> this area. <br /> 'fhe City Attorney indicated that if the property is not exempt from an <br /> EAW, then ordering an EAW is at the discretion of the City Council. hi <br /> that case the issue is whether or not the Council is convinced based on the <br /> evidence presented. He noted that given a petition signed by 25 <br /> individuals has not been presented, it was his position that the EAW issue <br /> is just not before the Council. The City Attorney recommended that the <br /> Council proceed with action on the Final Plat. <br /> Montour again stated that the consensus is that the EAW is a moot point, <br /> and indicated the Council would move forward with action on the Final <br /> Plat. He thanked Mr. Himmelbach for his comments. Himmelbach asked <br /> the Council to move foitivard with the Final plat including the condition <br /> that an EAW be ordered. <br /> The City Planner reviewed the Gervais Woods final plat indicated that <br /> staff is recommending approval subject to compliance with his <br /> recommendations as well as those of the City Engineer and the Parks & <br /> Recreation Commission. McGraw asked about landscaping of Outlot B. <br /> The City Administrator reported that in meeting with the adjacent property <br /> owner, the preferred approach is to mow a 20-foot edge of Outlot B <br /> abutting the street and leave the rest of the lot as natural. <br /> There was no one else present wishing to comment on this matter. <br /> Upon motion by Keis, seconded by Boss, the public hearing was closed. <br /> McGraw asked if there would be a monument sign on Outlot A as welt as <br /> who would be responsible for maintenance of Outlot A. Nathan Pair, <br /> Landmark Development, indicated that there would be irrigation on Outlot <br /> A; and Outlot A and B would be maintained by the homeowners <br /> association. The monument sign for the development will be located on <br /> Lot 1. McGraw asked what other responsibilities the homeowners <br /> association would have. Pair replied that there are four rainwater gardens <br /> as part of the development and these will be maintained by the <br /> homeowners association. McGraw asked if the street would be public or <br /> private. hair replied that the sriā¢eet would be public. <br /> Himmelbach asked if he would have had a better chance getting an EAW <br /> if he had not spoken this even. The Council declined to reply. <br /> Mr. McGraw introduced the following resolution and moved its adoption: <br /> 9 <br /> <br />
