MINUTF,S
CITY COUNCIL
MARCH 24, 2010
protected. Hinnnelbach asked that the Council at least direct excavation
away from the ridge until he can get the State Archeologist to look at the
area.
The City Administrator noted that, as discussed before, the artifacts should
be located so that the appropriate people can evaluate them.
Montour stated that he agrees with comments made by Keis and Montow•
that no new information has been presented. Montour informed Mr.
I Iimmelbaoh that a petition signed by 25 people would be needed to order
an EAW, but cautioned him that even if such a petition is received, the
project may be exempt. Montour stated that he appreciates Mr.
Himmelbach's concerns, but noted that no evidence has been presented.
Montour felt it appropriate to proceed with the plat.
The City Administrator pointed out that even if a petition for an EAW is
presented that has been signed by 25 individuals, the City Council still
retains the decision on whether or noti to order the EAW. A petition does
not mandate an EAW. "fhe City Administrator pointed out as an example,
The Preserve development which consisted of more lots and was in an
environmentally sensitive area. An EAW was not ordered for this
property.
Keis indicated that nothing has been presented to day that would convince
him that an EAW is necessary. Boss stated that it is unfortunate that Mr.
Himmelbach has not been able to locate his artifacts to have them
reviewed.
Himmelbach asked if his affidavit was worthless. Keis stated that the
affidavit is not convincing without the artifacts. Himmelbach asked if his
previous communications held merit. McGraw pointed out that no one has
seen the artifacts. He pointed out that Mr. Himmelbach has been raising
this issue for the past 2 '/z years and has not produced the artifacts.
McGraw also noted that Mr. I iimmelbach brought two people, the former
State Archeologist and the Mr. Callahan, an anthropologist, during the
winter when it was not possible to do an evaluation. McGraw informed
Mr. Himmelbach that he has dropped the ball on this one, noting that he
cannot locate the artifacts and he has not taken the steps to have them
authenticated. Himmelbach felt this was more the City's responsibility
than his and that he is requesting the City have the site investigated.
McGraw stated that he could see no reason to have the site investigated.
Montour noted that the consensus is that there is no strong evidence that
this is a significant archeological site in Minnesota. Montour
acknowledged that Mr. Himmelbach has a different opinion. Hinnnelbach
stated that the artifacts that he has found could be older than the oldest
K
