Please understand that <br /> this document is subject to the approval of the City Council I anticipate that approval will be granted at <br /> tonight's Council Meeting. Ideally, it would be nice to larow prior to or at the meeting if these proposed <br /> terms are acceptable to you. The terms are as follows: <br /> ? You will dedicate a 50-foot utility easement to the City in the area approximated on the attached <br /> diagram. (This reflects the layout that shifted the easement farther north of your home per your <br /> request.) The utility easement cannot be used to construct a stl•eet/road without acquiring <br /> additional rights from you. The City anticipates the road right-of-way will ultimately be <br /> dedicated by you (or the property owner at the time) when the property is developed pursuant to <br /> the City's subdivision ordinances. As I have stated to you on numerous occasions, the City is <br /> not interested in constlvcting a road that does not benefit abutting property. <br /> ? You will also agree to dedicate a 25-foot wide utility easement that will comiect the new sanitary <br /> sewer line to be constructed to the Sculley property. The preference is to dedicated that easement <br /> at such time as your or the Sculley property is developed to avoid making as many estimates <br /> about potential development layout. Ideally, this would occur within 30 days notice from the <br /> City if the Sculley's land were to develop first. <br /> ? The amount of compensation paid will result in no special assessments, either active or deferred, <br /> for your property in association with the construction of the new sanitary sewer line. The <br /> estimated breakdown of this transaction is as follows: <br /> Easement- 28, 075 Sq. Ft. @ $1.275/sq. ft. = 35,800 <br /> Land Damages -181,432 @$.075/sq. ft. = 13,600 <br /> Impact to Dwelling = 3,050 <br /> Appraisal Allowance = 2,500 <br /> Eminent Domain Avoidance = 15.000 <br /> Total Compensation = 69 950 <br /> <br />
