<br /> 4. JPL shall also assist the City in the organization and management of its <br /> Inspections Department including, but not limited to, ordinance reviews to <br /> ensure consistency with other codes and current practices, form revisions <br /> to provide appropriate documentation of services provided, policy <br /> revisions to enhance the quality of work, and preparation of public <br /> information materials to make citizen dealings with the City as efficient as <br /> possible based upon a customer service attitude. <br /> 5. Fire Marshal shall not be required, but may be requested from time to <br /> time, to attend Little Canada City Council meetings. The Fire Marshal <br /> shall attend preconstruction meetings for commercial and residential <br /> projects as needed based upon a request from the City's building official. <br /> 6. City shall, if requested by JPL, provide input from its fire department, <br /> police service provider, public works superintendent, planning consultant, <br /> building official and other staff members as appropriate <br /> 7. Fire Marshal shall have the exclusive initial authority to determine <br /> interpretations and applications of the fire code to projects within the City. <br /> Notwithstanding the foregoing, Fire Marshal shall confer with the City <br /> Administrator of City before issuing any such interpretations and <br /> applications of the fire code which might have an extraordinary significant <br /> effect on projects within the City. Fire Marshal shall also have the right <br /> and responsibility to issue stop work orders and violations of the fire code. <br /> Enforcement and prosecution of the fire code requirements by way of <br /> judicial action for either criminal or civil sanction shall remain the exclusive <br /> responsibility of City. JPL shall cooperate in any enforcement procedures. <br /> 8. Upon completion of all fire inspections, JPL shall file the original <br /> inspection records, along with the plans, with the City weekly. All such <br /> inspections shall be kept on file pursuant to State law. All such original <br /> records shall remain the exclusive property of the City. <br /> B. GENERAL TERMS AND CONDITIONS: <br /> The parties further agree as follows: <br /> 1. JPL shall at all times during the term of this Agreement ensure that its <br /> personnel remain current in terms of knowledge and familiarity with all <br /> applicable codes. JPL is responsible for the training and direction of all <br /> JPL personnel. <br /> 2. City shall remit payment to JPL for services rendered under this <br /> Agreement. The City shall not assume any liability for the direct payment <br /> of any salary, wage or benefit to JPL's principals or employees, nor shall it <br /> assume any responsibility for compliance with workers' compensation <br /> insurance statutes or tax laws relating to said personnel. The City shall <br /> not make any other type of compensation directly to the person <br /> designated as Fire Marshal for performing services pursuant to this <br /> <br />
