MINUTES
CITY COUNCIL
MAY 12, 2010
year. Sherman has also indicated that he has leased another 5,000 square
feet of the building.
The City Administrator felt that if the City proceeds with default
provisions, he believes the City would jeopardize the TIF guarantees in
place on The Village and Parcel #4. The Administrator did not feel the
City would gain much in taking the property back given current economic
conditions. He also noted that non-payment of taxes does not trigger
collection through the Letter of Credit that is in place. The Administrator
asked the Council if They were willing to work with Sherman Associates
relative to this default.
It was the consensus of the Council to work with Sherman Associates and
given him until the end of the year to get property taxes current. There
was some discussion on whether or not it was typical that a Letter of
Credit could not be used in a situation of this kind. The City
Administrator pointed out that Briggs and Morgan drafted the docwnents,
therefore, it would be his impression that this would be typical.
R. J. MARCO/ Montour asked if R. J. Marco was going to proceed with development
VIKING DRIVE of the other Viking Drive parcel. The City Administrator reported that
they will be proceeding. There is some title action that is being completed
on the property and then the Melancon Plat will be filed. Once that is
completed, the project should be underway. The Administrator also
reported that R. J. Marco was not able to acquire some excess land from
the shopping center property on Minnesota Avenue. However, the project
will proceed without that land although at a slightly smaller footprint.
LITTLE The City Administrator reviewed a draft outline of a Request for Proposals
CANADA for Little Canada Road sheatseape design. The Administrator indicated
ROAD that as he was working on this outline, a Little Canada Road resident
STREETSCAPE requested that the City consider the installation of a sidewalk along Little
RFP Canada Road east of the freeway. As a result, some thought has been
given to existing right-of-way along that segment of Little Canada Road as
well as whether four lanes are necessary.
The City Administrator reported that he has been in preliminary
discussions with the County on these issues as well as their timeline for
recycling the roadway. Jim "I"olaas of the County has indicated that while
the recycling is not on the County's plan through 2014, the County has
been willing to work with cities and accelerate projects in some cases. He
also indicated that it may be possible to narrow lane width or reduce the
number of lanes on Little Canada Road east of Centerville Road. This
2
