<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> JUNE 9, 2010 <br /> Keis noted that the City has been very lenient on alcohol violations in the <br /> past with the exception of the last violation. McGraw asked how often a <br /> policy of this nature should be reviewed. The City Attorney felt a review <br /> every two to five years would be appropriate, pointing out that the City <br /> has not been faced with many violations of this nature. Blesener agreed. <br /> The City Administrator stated that he will bring this matter back to the <br /> Council in the near future. <br /> LICENSING The City Administrator reported that the City has closed on the pw~chase <br /> AGREEMENT of the Roseville Plumbing property. As part of the title work that was <br /> WITH done in relation to this purchase, it was noted that the existing driveway <br /> DONOVAN to the Roseville Plumbing property was not located in the driveway <br /> CONSTRUCTION easement. Three options existed for resolving this situation, those being to <br /> move the existing driveway within the easement, obtain a new driveway <br /> easement in the location of the driveway, or enter into a licensing <br /> agreement for the driveway as it currently is located. The City <br /> Administrator indicated that given the redevelopment potential of the area <br /> and the likelihood that when the property is redeveloped, access through <br /> the area would be relocated, the licensing agreement option appears to be <br /> the most practical at this time. The City Administrator reported that <br /> Donovan Construction is agreeable to the licensing agreement. <br /> The City Administrator reported that with the assistance of the City <br /> Attorney a licensing agreement for the driveway has been drafted for the <br /> Donovan Construction property. There will be the need to obtain another <br /> licensing agreement with the property owner of the site along South <br /> Owasso Blvd. That agreement will be presented to the Council at a later <br /> date. <br /> Blesener noted that the easement is only 33 feet in width, and indicated <br /> that a road improvement would require a wider easement. The City <br /> Administrator agreed, but noted that future access will likely not be in the <br /> same area as the existing driveway easement. He also pointed out issues <br /> with providing access from the south, and indicated that the most feasible <br /> access would likely come from the north. <br /> Mr. McGraw introduced the following resolution and moved its adoption: <br /> RESOL UTION NO. 2010-G-I47 -APPROVING THE LICENSING <br /> AGREEMENT WITH DONOVAN CONSTR UCTION FOR ACCESS <br /> TO THE ROSEVILLE PLUMBING PROPERTYAND <br /> AUTHORIZING THE MAYOR AND CITYADMINISTRATOR TO <br /> EXECUTE ON BEHALF OF THE CITY <br /> 5 <br /> <br />
