<br /> MINUTES <br /> <br /> CITY COUNCIL <br /> <br /> JUNE 9, 2010 <br /> The foregoing resolution was duly seconded by Boss. <br /> Ayes (4). <br /> Nays (0). Resolution declared adopted. <br /> NUISANCE The City Administrator reviewed the Code Enforcement Officer's <br /> ABATEMENT- recommendation that the City proceed with nuisance abatement for <br /> 29 AND 29'/: the property at 29 and 29 '/2 Demont Avenue, noting that the <br /> DEMONT nuisance had not been abated as of This evening's meeting. The <br /> AVENUE property owner has been notified of the process. <br /> Blesener asked if the property was bank-owned, noting that it appears to <br /> be vacant. The City Administrator indicated that the City does not lo~ow <br /> whether or not the property is in the foreclosure process. <br /> Mr. Blesener introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2010-6-192 -AUTHORIZING THEABATEMENT <br /> OF NUISANCE AT 29 AND 29 % DEMONT STREET AS <br /> RECOMMENDED BY THE CODE ENFORCEMENT OFFICER <br /> The foregoing resolution was duly seconded by Keis. <br /> Ayes (4). <br /> Nays (0). Resolution declared adopted. <br /> HIMMELBACH The City Administrator reported that Mr. Dave Himmelbach has <br /> EASEMENT executed the easement agreement with the City which would allow for <br /> AGREEMENT the extension of sanitary sewer and water main through his property, <br /> providing a connection from the Kohlman Lane area to Gervais Woods. <br /> The Administrator noted that only sanitary sewer is planned at this time. <br /> The Administrator pointed out that this easement does not allow for the <br /> extension of a road improvement through the area. At the time that the <br /> I-Iimmelbach and Battista properties are proposed fox development, street <br /> right-of-way would have to be dedicated. That Administrator also <br /> indicated that the City Council approved the compensation package for the <br /> Himmelbach easement at a previous meeting. <br /> "the Administrator anticipated that the Battista easement document would <br /> be executed next week, and indicated that he would bring it to the Comicil <br /> for approval when it is available. <br /> Mr. McGraw introduced the following resolution and moved its adoption: <br /> 6 <br /> <br />
