The Commission had some discussion of this issue, and the City <br /> Planner recommended that the City )?ngincer review and comment on this <br /> issue to the City Council. The Commission was agreeable to that <br /> approach. <br /> The Commissioners comments on the attractiveness of the building and <br /> felt this was a good proposal for a somewhat challenging piece of <br /> property. <br /> F,verson recommended approval of the Architectural Review for the <br /> proposed Subway Restaurant at 85 West Viking Drive subject to <br /> compliance with the recommendations of the City Planner as outlined in <br /> his report dated July 1, 2010 and subject to the City Engineer reviewing <br /> the issue of the driveway access to the site in conjunction with traffic <br /> visibility issues. <br /> Motion seconded by Knudsen. <br /> Motion carried 7 - 0. <br /> AMEND The City Planner reported that when the City f ist took up the issue <br /> ZONING of interim use permits for outdoor storage by non-building occupants <br /> CODE - of a property, it wanted to proceed slowly. As a result, the Code was <br /> IUP drafted to impose a one year term for these interim use permits. In <br /> TERMINATION addition, the Code also required an outdoor storage license in <br /> DATES conjunction with an interim use permit. The combination of the permit <br /> and the license affords the City some additional controls. <br /> The City Planner indicated that a one year turn-arowrd is a short period of <br /> time for the businesses involved. He noted that once the interim use <br /> permit ends after the year, these businesses are required to reapply and go <br /> through the zoning process for approval of another interim use permit. <br /> The Planner indicated that City staff has raised this issue and has <br /> suggested that given current economic conditions, that a period of time <br /> longer than one year would feasible. <br /> Knudsen felt that the City was correct in being conservative at the on-set <br /> and establishing the one year interim use permit. He suggested that <br /> perhaps all initial interim use permits should be one year in length, and <br /> subsequent permits could be of a longer duration. The City Planner felt <br /> that would be an option, but again noted that should the City have a <br /> compliance problem with a business, it has the outdoor storage license that <br /> could be revoked. The Planner felt a longer duration for the interim use <br /> permit was workable given the protection the City has under the outdoor <br /> -4- <br /> <br />
