<br /> MINUTES <br /> CITY COUNCIL <br /> AUGUST 11, 2010 <br /> good business relationship in I:~ittle Canada. Helling indicated that if the <br /> transfer is not approved, he may be out of business. <br /> Montour pointed out that there are empty store fiā¢onts in MGM's current <br /> location. Felling stated that that was true, pointing out that Davis Lock <br /> was along-term tenant that recently moved because of diff culties in <br /> negotiating with the new ownership. Helling reported that the rents are <br /> too high at his current location and no one is willing to pay them. <br /> Montour stated that he was disappointed out that property owner at Rice <br /> Street and Little Canada Road would not work with M(iM Liquors. Keis <br /> stated that he did not like the relocation proposed, but indicated that he did <br /> not feel there was a basis to say no. <br /> The City Administrator pointed out that neither State Statute nor the City <br /> Code requires a distance separation between liquor stores. "I'he <br /> Administrator suggested the matter could be tabled and the City <br /> Attorney's opinion sought. The Administrator indicated, however, that he <br /> saw no basis for denying the request other than if there were performance <br /> issues with the owner. <br /> McGraw also indicated that he was uncomfortable with the request, but <br /> saw no basis for saying no. McGraw felt that it was not his job as a <br /> Council Member to legislate where a business could go outside of <br /> enforcing zoning regulations. <br /> Blesener stated that he was having a difficult time with the request, and <br /> would prefer to see it tabled pending a~~ opinion from the City Attorney. <br /> McGraw asked if the property improvements would be done before M(iM <br /> relocates. Belling replied that they would. He indicated that his <br /> anticipated relocation date would be October 1, 2010. <br /> Mr. Keis introduced the following resolution and moved its adoption: <br /> RESOL UTION NO. 2010-8-185 -APPROVING TFIE TRANSFER OF <br /> AN OFF-SALE LIQUOR LICENSE FOR MGM LIQUOR FROM 2680 <br /> RICE STREET TO 2768 RICE STREET FOR THE LICENSE <br /> PERIOD OF OCTOBER I, 2020 THROUGH JUNE 30, 2010 <br /> The foregoing resolution was duly seconded by McGraw. <br /> Ayes (3). <br /> Nays (1) Blesener. Resolution declared adopted. <br /> 5 <br /> <br />
