Summary of Facts in Support of <br /> Etch Auto Sales LLC Application for Conditional Use Permit <br /> 3150 Spruce Street, Little Canada, MN 55117 <br /> City of Little Canada, Minnesota <br /> <br /> This statement is submitted in supporC of Eich Auto Sales LLC, and its owners Nicole B. <br /> <br /> Luciw and Michele E. Misiak (together, "the Petitioners"), application for Conditional <br /> <br /> Use Permit ("CUP") under City Ordinance Section 914.040, Light Industrial District <br /> Zoning, subsections (D) Motor Vehicle Sales Lot and (G) Open and Outdoor Storage. <br /> On March 9, 1992 Joseph Eich, prior owner of Eich Auto Sales and father of the current <br /> owners, appeared before the Little Canada Planning Commission in support of his <br /> application for a CUP for the property located at 3150 Spruce Street, Little Canada, MN <br /> 55117. The application presented was for "Accessory, Enclosed Retail Sales of Used <br /> Cars". The application was approved and Joseph Eich was annually approved for license <br /> renewal for "Retail Auto Sales" through June 2010. Prior to submitting his application <br /> and continuously and openly since approval of the application, for a period greater than <br /> twenty (20) years, Eich Auto Sales has maintained a "Motor Vehicle Sales Lot" under the <br /> definition of 914.040(D) with overflow "Outdoor Storage" under the definition of <br /> 914.040(G). <br /> On January 18, 2010 Joseph Eich passed away. <br /> On April 1, 2010 Petitioners applied for a Used Auto Dealer's License with the <br /> Mimnesota Department of Public Safety. The application was approved and Dealers <br /> License #36976 was issued to Eich Auto Sales LLC on that date. On or about that same <br /> date, The City of Little Canada approved assignment of the CUP license from Joseph <br /> Etch to Eich Auto Sales LLC. <br /> On April 8, 2010 Nicole B. Luciw was appointed as the personal representative in the <br /> Estate of Joseph T. Etch. <br /> On May 14, 2010 Petitioners paid $300.00 for renewal of the Auto Retail Sales License <br /> to run from July 1, 2010 through June 30, 2011. <br /> On May 21, 2010, the City of Little Canada presented an application and invoice for <br /> Outdoor Storage license generally directed to "Little Canada Property Owner". <br /> Petitioners responded on May 28, 2010 with payment of $50.00 for the annual license for <br /> Outdoor Storage covering the period July 1, 2010 through June 30, 2011. <br /> On August 12, 2010 the Petitioners met with Stephen W. Grittman, Little Canada City <br /> Planner and Jessica Jagoe, Little Canada License Renewal Coordinator. The parties <br /> discussed the approved use of "Retail Auto Sales" and the actual use of "Motor Vehicle <br /> Sales Lot" and "Outdoor Storage". The Petitioners were directed to complete the <br /> Application. for CUP to reflect the actual and current use of the property. <br /> <br />
