<br /> The Petitioners presented photographs to show their compliance with the provisions of <br /> <br /> both Sections 914.040(D) and 914.040(G). Finally, the Petitioners also discussed a <br /> request for a partial waiver of the requirements of Section 914.040(G)(8) Screening, due <br /> <br /> to a series of break-ins that have occurred in the Ryan Industrial Park neighborhood, to <br /> include the premises of Eich Auto Sales LLC. <br /> The Petitioners were instivcted to complete this summary and present their request to the <br /> City Planning Commission September 9, 2010 and subsequently to the City Council as <br /> may be required for approval of the Conditional Use Permit and Request for Partial <br /> Waiver. <br /> COMPLIANCE WITH 914.040(D) <br /> 1. Outside services and sales are associated with a principal building of at least one <br /> thousand (1000) square feet of floor area <br /> a. Building size is three thousand twenty four (3,024) square feet <br /> 2. The entire sales lot and off street parking area is paved <br /> a. See photos attached hereto <br /> 3. Vehicles being displayed shall be in operable condition and shall be licensed <br /> according to the State sales license held by the business. <br /> a. All vehicles displayed on the sales lot are operable and licensed in <br /> accordance with State sales licensing requirements. <br /> 4. A minimum of three hundred eighty (380) square feet of sales area per vehicle is <br /> provided and no more than ten (10) vehicles may be displayed outdoors at any <br /> time. <br /> a. Minimum sales square footage is met. See Photos attached hereto. <br /> b. More than ten (10) vehicles are currently displayed, however Petitioners <br /> utilize "Accessory Open and Outdoor Storage" for additional vehicles. <br /> See hereafter, Compliance with 914.040(G). <br /> 5. Adequate off-street parking and off-street loading is provided <br /> a. See photos attached hereto <br /> 6. Perimeter curbing is provided around sales/parking lot. <br /> a. See photos attached hereto <br /> 7. A strip of not less than five (5) feet adjacent to the public right-of--way shall be <br /> landscaped and screened. <br /> a. See photos attached hereto <br /> 8. Such use is not located within two hundred feet of residentially zoned property <br /> a. The premises are located within a zoned Industrial Park. <br /> 9. No more than two (2) motor vehicle sales lot licenses may be in full force at any <br /> one time in the B-2 and B-3 Districts and no more than a total of four (4) such <br /> licenses may be in force at any one time in the B-2, B-3, B-4 and I-1 Districts. <br /> a. The City of Little Canada will confirm that Eieh Auto Sales LLC is in <br /> compliance with this provision. <br /> 10. License is subject to annual renewal <br /> 11. Provisions of Section 921.01 OC are met. <br /> <br />
