The Petitioners presented photographs to show their compliance with the provisions of both Sections 914.040(D) and 914.040(G). Finally, the Petitioners also discussed a request for a partial waiver of the requirements of Section 914.040(G)(8) Screening, due to a series of break-ins that have occurred in the Ryan Industrial Park neighborhood, to include the premises of Eich Auto Sales LLC. The Petitioners were instivcted to complete this summary and present their request to the City Planning Commission September 9, 2010 and subsequently to the City Council as may be required for approval of the Conditional Use Permit and Request for Partial Waiver. COMPLIANCE WITH 914.040(D) 1. Outside services and sales are associated with a principal building of at least one thousand (1000) square feet of floor area a. Building size is three thousand twenty four (3,024) square feet 2. The entire sales lot and off street parking area is paved a. See photos attached hereto 3. Vehicles being displayed shall be in operable condition and shall be licensed according to the State sales license held by the business. a. All vehicles displayed on the sales lot are operable and licensed in accordance with State sales licensing requirements. 4. A minimum of three hundred eighty (380) square feet of sales area per vehicle is provided and no more than ten (10) vehicles may be displayed outdoors at any time. a. Minimum sales square footage is met. See Photos attached hereto. b. More than ten (10) vehicles are currently displayed, however Petitioners utilize "Accessory Open and Outdoor Storage" for additional vehicles. See hereafter, Compliance with 914.040(G). 5. Adequate off-street parking and off-street loading is provided a. See photos attached hereto 6. Perimeter curbing is provided around sales/parking lot. a. See photos attached hereto 7. A strip of not less than five (5) feet adjacent to the public right-of--way shall be landscaped and screened. a. See photos attached hereto 8. Such use is not located within two hundred feet of residentially zoned property a. The premises are located within a zoned Industrial Park. 9. No more than two (2) motor vehicle sales lot licenses may be in full force at any one time in the B-2 and B-3 Districts and no more than a total of four (4) such licenses may be in force at any one time in the B-2, B-3, B-4 and I-1 Districts. a. The City of Little Canada will confirm that Eieh Auto Sales LLC is in compliance with this provision. 10. License is subject to annual renewal 11. Provisions of Section 921.01 OC are met.
