a. To the best of Petitioners knowledge and belief the following conditions <br /> have been met continuously and openly for more than twenty (20) years <br /> (see also attached photos) <br /> i. The applicant shall demonsttate by clear and convincing evidence <br /> that the proposed action has been considered in relation to the <br /> specific policies and provisions of and has been found to be <br /> consistent with the official City Comprehensive Land Use Plan. <br /> ii. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed site is or will be compatible with present and <br /> future land uses of the area. <br /> iii. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed use conforms with all performance standards <br /> contained herein. <br /> iv. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed use will not tend to or actually depreciate the <br /> aggregate property values in the area in which the amendment or <br /> conditional use is proposed. <br /> v. The applicant shall demonstrate by clear and convincing evidence <br /> that the proposed use can be accommodated with existing public <br /> services and will not overburden the City's service capacity. <br /> vi. The applicant shall demonstrate by clear and convincing evidence <br /> that the development of the conditional use shall reflect the <br /> architectural character of the conforming buildings in the <br /> surrounding area in regard to the following: <br /> a. Proportion, scale and roof line; <br /> b. Architectural style; and <br /> c. Exterior finish materials. <br /> <br /> COMPLIANCE WITH 914.040(G) <br /> 1. The activity of outdoor storage shall require a separate business license issued <br /> by the City of Little Canada. <br /> a. The Petitioners have applied for Outdoor Storage licensing under this <br /> provision as an accessory to their Motor Vehicle Sales Lot under 914.040 <br /> (D). <br /> 2. The storage area in question occupies an area no greater than sixty (60) <br /> percent of the gross square footage of the subject parcel. <br /> a. The storage area utilized for vehicles in excess of the ten (10) vehicles <br /> permitted under Section 914.040(D) comprises less than sixty (60) percent <br /> of the gross square footage of the premises <br /> b. See attached photos <br /> 3. The storage area shall not occupy any portion of the yard between the front <br /> building line and the adjoining public street, or the side building line and <br /> public street on a corner lot. <br /> a.
