<br /> MINUTIJS <br /> <br /> CITY COUNCIL <br /> <br /> AUGUST 25, 2010 <br /> The Planner reported that the applicant is looking to lease the property to <br /> another tenant that would use it for both residential and commercial <br /> purposes. That tenant is a small trucking company. The owner would <br /> occupy the home and utilize the rear building for his business. It has been <br /> indicated that there would be no outdoor storage on the property, other <br /> than some daytime parking associated with the business. <br /> The Planner reported that the request raised the issue of the re-occupancy <br /> of a resident use on the property. The Planner noted that the City Council <br /> has declined this request in the past given its long-term plan to redevelop <br /> the area into a commercial use. The applicant is having trouble, however, <br /> in finding a tenant or a buyer for the property under those terms and is <br /> requesting that the Council reconsider the residential use. The Planner <br /> noted that under the PUD zoning, the Council has that discretion. The <br /> Planner noted that the Planning Commission recommended approval on a <br /> two-to-two vote. <br /> The City Administrator reported that he and the Code Enforcement Officer <br /> conducted a site visit and found that the property is already being occupied <br /> by the trucking company and there is outdoor storage on the site. The <br /> Administrator reported that he made contact with the owner of the <br /> bucking company who indicated that he would not be storing outdoors <br /> and will be storing equipment on the McDonald Battery property. The <br /> Administrator informed the trucking company owner (Scott Heckel) that <br /> outdoor storage was not allowed on the McDonald Battery property, azid <br /> this would be a violation of City Code. <br /> The City Administrator reported that the property at 2968 Rice Streit has <br /> had code enforcement issues over the years. He again noted that the <br /> trucking company is already establishing its use without the proper <br /> permits and including outdoor storage. The Administrator noted that <br /> given the narrow 70 foot width of the property, it will be difficult to turn a <br /> truck around in the property without encroaching onto the neighboring <br /> proper•Cy. That is already occurring as noted in the letter from the adjacent <br /> property owner. The Administrator stated that given the past issues with <br /> this property as well as the ongoing problems, both he and the Code <br /> Enforcement Officer recommend denial of the requested Amendment to <br /> PUD Permit. <br /> Marilyn Montreux, personal representative for the Anne Trobec estate, <br /> reported on the difficulty she is having in finding a buyer for this property. <br /> Montreux stated that she would like to lease or sell the property with a <br /> residential use in the house and a commercial use in the back. Montreux <br /> indicated that Mr. Heckel has indicated that he will not have outdoor <br /> storage on the property. <br /> 9 <br /> <br />
