<br /> MINUTES <br /> CITY COUNCIL <br /> SEPTEMBER 20, 2010 <br /> Committee, indicated that they would do their own backgrounds checks on <br /> these individuals. <br /> Montour pointed out that general members of an organization conducting <br /> ]awful gambling make decisions relative to gambling such as <br /> expenditures, hiring of gambling manager, appointment of the board of <br /> directors. He pointed out that the vote of a general member of these <br /> organizations is equal to the vote of a member of the board of directors. <br /> Blesener stated that his position is that the City is going too deep into the <br /> organization in conducting background checks on general membership. <br /> Keis agreed and felt that if backgrounds checks are conducted on general <br /> membership, that would be for the organization to decide. <br /> 'The City Clerlc noted that the background check requirement was put in <br /> place in the City's early days of charitable gambling, when many of the <br /> lawful gambling organizations were outside organizations. At this time <br /> there are only local organizations conducting lawful gambling in the City, <br /> as is now required by Code. The City Administrator also noted that State <br /> enforcement of lawful gambling has changed tremendously from the early <br /> days of lawful gambling. He felt that because of this, the need for City <br /> enforcement has abated over time. Blesener noted that even the licensing <br /> of lawful gambling organizations has changed from annual licenses to <br /> perpetual licenses. <br /> Mr. Blesener introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2010-9-228 -AMENDING THE CITY'S LAWFUL <br /> GAMBLING ORDINANCE TO COINCIDE BACKGROUND CHECK <br /> REQUIREMENTS WITH THAT REQUIRED BYSTATE STATUTE <br /> The foregoing resolution was duly seconded by Keis. <br /> Ayes (5). <br /> Nays (0). Resolution declared adopted. <br /> CONSENT Ms. Boss introduced the following resolution and moved its adoption: <br /> AGENDA <br /> RESOLUTION NO. 2010-9-229 -APPROVING THE CONSENT <br /> AGENDA WHICH CONTAINS THE FOLLOWING: <br /> *APPROVAL OF THE VOUCHERS; <br /> *CALLING FOR A BUDGET WORKSHOP FOR WEDNESDAY, <br /> OCTOBER 27, 2010 AT 6:30 P.M.; <br /> 10 <br /> <br />
