It was noted that the Planning Commission <br /> LAPHAM- recommended approval subject to compliance with the recommendations <br /> HICKEY of the City Planner as outlined in his September 2, 2010 report with the <br /> STEEL corrected dimensions noted at the Planning Commission meeting. <br /> The City Planner indicated that the Lapham-Hickey Steel property is <br /> zoned Industrial-Park. They are requesting a Conditional Use Permit to <br /> occupy a portion of the outdoor storage area that was previously approved <br /> by CUP for Orius Corporation as the previous owners. At that time, the <br /> property was zoned Light-Industrial. The Planner noted that there are <br /> additional outdoor storage resri~ictions under I-P zoning. The applicant <br /> would be allowed to occupy no more than 25% of the building area, or <br /> 12,500 square feet, for outdoor storage at any given time. The Planner <br /> stated that it appears that the Lapham-Hickey proposal compliance with <br /> the I-P conditions, except for location. The Planner noted that the I-P <br /> District does not allow outdoor storage on the street side of any building. <br /> However, given the existing developed storage yard which is screened and <br /> landscaped, the Planner felt continued use of this storage yard was <br /> reasonable. Again, the maximum amount of the storage yard that could be <br /> used would consist of 25% of the building size, or a maximum of 12,500 <br /> square feet. Lapham-Hickey has indicated that they would be utilizing <br /> less than that amount. <br /> There was no one present from the general public wishing to comment on <br /> this proposal. <br /> Upon motion by Boss, seconded by Keis, the public hearing was closed. <br /> Montour asked whether there was a lapse in outdoor storage use from the <br /> Orius ownership of the property to the Lapham-Hickey ownership. The <br /> City Planner indicated that there was and the facility stood empty for a <br /> couple of years. Therefore, the I-P District regulations now apply and <br /> there is no grandfathering in of I-1 District regulations. <br /> Ms. Boss introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2010-9-221- APPROVING A CONDITIONAL <br /> USE PERMIT FOR OUTDOOR STORAGE FOR 3250 SPRUCE <br /> STREET, LAPHAM-HICKEY STEEL, SUBJECT TO COMPLIANCE <br /> WITH THE RECOMMENDATIONS OF THE CITY PLANNER AS <br /> OUTLINED IN HIS REPORT DATED SEPTEMBER 2, 2010 <br /> The foregoing resolution was duly seconded by Montour <br /> Ayes (5). <br /> Nays (0).
