<br /> MINUT)JS <br /> <br /> CITY COUNCIL <br /> OCTOBIJR 19, 2010 <br /> fixed income can request an assessment deferral provided that income guidelines <br /> are met. Assessments for undeveloped portions of lots can be deferred until <br /> developed. However, deferred assessments do accrue interest. The City <br /> Administrator pointed out that the first year's interest on an assessment will <br /> include interest for the balance of 2010 as well as the full year for 2011 <br /> (essentially an extra 73 days). <br /> The City Administrator pointed out that the Council's actions to assess the <br /> residential portion of this project on a per unit basis, utilizing a maximum <br /> frontage of 100 feet. This action resulted in a reduction in assessment to <br /> residential properties of approximately $1,500 from what was initially proposed. <br /> Sternal asked if the assessment was tax deductible. The City Administrator <br /> indicated that the City has heard both that it is deductible and that it is not. He <br /> suggested that property owners consult with a tax consultant on that issue. <br /> Jim LaCasse, owner of 40 and 90 Iona Lane, expressed conceni with the <br /> assessment. He felt that had the street been property designed and constructed to <br /> begin with, only a mill and overlay would have been needed at this time rather <br /> than a full reconsriuction. LaCasse indicated that he would file a formal objection <br /> to the assessment this evening, and asked for his neighbors' support. <br /> Don Pierce agreed that the street was not properly constructed to begin with and <br /> indicated that he has complained about that to the City over the years. <br /> The City Adminishator noted that State Statute requires that formal objections to <br /> the assessment be filed in writing this evening. <br /> LaCasse again commented on the poor initial construction of the street and the <br /> poor seal coating methods that were used. He noted that there had been no crown <br /> in the street, thus drainage problems. LaCasse pointed out that the feasibility <br /> report for the improvement noted that there was poor base under the road and <br /> likely contamination of subsoils. <br /> The City Administrator pointed out that this evening the assessment hearing is <br /> being held to consider adoption of the assessment roll. This is the property <br /> owners' opportunity to file a formal written objection to the assessment. <br /> LaCasse stated that he did not disagree that the project needed to be done, but is <br /> objecting to the cost being passed onto property owners. LaCasse submitted a <br /> written formal objection to the assessment on behalf of himself acid some of the <br /> other property owners present. <br /> Upon motion by Boss, seconded by Keis, the public hearing was closed. <br /> IS <br /> <br />
