<br /> MINUTIJS <br /> CITY COUNCIL <br /> OCTOBER 19, 2010 <br /> 'The City Administrator reported that the written formal objection submitted is <br /> signed by James L,aCasse, 40 and 90 Iona Lane, John Hendricks, 80 Tona Lane, <br /> Donald Pierce, 30 Iona Lane, and Robert Sternal, 61 Iona Lane. The City <br /> Administrator reported that submission of this objection preserves the rights of <br /> these property owners to appeal their assessment to District Court. The City <br /> Administrator reported that the assessment roll for the Iaia Lane improvement <br /> project is based on the City's Assessment Policy. The City Administrator <br /> reported it is City staff s position that the assessment is fair and equitable and <br /> does not exceed benefits received to any of the properties. He also noted that the <br /> Assessment Policy has been upheld in Court. The City Administrator <br /> recommended that the Cowlcil acknowledge receipt of the objections and that the <br /> Council then act to deny the objections. <br /> Ms. Boss introduced the following resolution and moved its adoption: <br /> RESOL UTION NO. 2010-10-258 -ACKNOWLEDGING RECEIPT OF <br /> OBJECTIONS TO ASSESSMENTS SUBMITTED BY: <br /> JAMES LACASSE, 40 AND 90 IONA LANE; <br /> JOHN HENDRICKS, 80 IONA LANE; <br /> DON PIERCE, 30 IONA LANE; <br /> ROBERT STERNAL, 61 ]ONA LANE <br /> The foregoing resolution was duly seconded by Blesener. <br /> Ayes (3). <br /> Nays (0). Resolution declared adopted. <br /> Mr. Blesener introduced the following resolution and moved its adoption: <br /> RESOLUTION NO. 2010-10-259 -ADOPTING THE ASSESSMENT ROLL <br /> FOR IMPROVEMENT NO. 2010-04, IONA LANE, AS SUBMITTED BY THE <br /> CITY ENGINEER AND DENYING THE OBJECTION TO ASSESSMENT <br /> SUBMITTED BY THE FOLLOWING PROPERTY OWNERS <br /> JAMES LACASSE, 40 AND 90 IONA LANE; <br /> JOHN HENDRICKS, 80 IONA LANE; <br /> DON PIERCE, 30 IONA LANE; <br /> ROBERT STERNAL, 61 IONA LANE; <br /> WITH THE DENIAL OF OBJECTION BASED ON THE FACT THAT THE <br /> ASSESSMENT ROLL IS BASED ON THE CITY'S ASSESSMENT POLICY, <br /> AND THE ASSESSMENT DOES NOT EXCEED BENEFITS RECEIVED <br /> The foregoing resolution was duly seconded by Keis. <br /> Ayes (3). <br /> Nays (0).
