MINUTES <br />CITY COUNCIL <br />NOVEMBER 22, 2010 <br />TIONMENT <br />However, the management company for the association has now requested <br />that the assessments be apportioned and certified to each individual <br />townhome unit. The management company does not wish to manage the <br />collection of these costs. The company has reported that of the 22 <br />townhomes, the owners of 14 of the units have paid their share of the <br />assessment in full. This leaves 8 units that would have assessments <br />certified to the County for collection with property taxes, if the Council <br />supports the request of the management company. <br />The City Administrator recommended that the apportionment be approved <br />by the Council as requested, provided that each of the owners of the 8 <br />units sign an apportionment request and waiver of right to appeal the <br />assessment. The Administrator reported that the County has indicated that <br />this process is acceptable from their standpoint. The Administrator <br />indicated that the townhome association will be having a meeting of its <br />ownership, and will be submitting the appropriate waivers. <br />Mr. Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2010 -11 -283 APPROVING THE <br />CERTIFICATION OF JACKSON STREET ASSESSMENTS TO <br />INDIVIDUAL PARKVIEW COURT TOWNHOMESAS REQUESTED <br />PROVIDED THAT THE CITY RECEIVES EXECUTED <br />APPORTIONMENT REQUESTS AND WAIVERS OF RIGHT TO <br />APPEAL SPECIAL ASSESSMENTS FROM THE IMPACTED <br />PARKVIEW COURT PROPERTY OWNERS <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />CANADIAN The City Administrator noted that when the Council approved the <br />DAYS Premises Permit allowing Canadian Days to conduct lawful gambling <br />PREMISES at Gas N Go, it required a six -month review of that approval. That <br />PERMIT AT six -month period will lapse shortly, and both Canadian Days and the <br />GAS N GO owner of Gas N Go are requesting that the Council provide for final <br />approval of that premises permit. Blesener commented that the site <br />appears to be working well. It was also noted that the State now has <br />perpetual permits, with the Administrator noting that problems at any <br />lawful gambling sites would be addressed through enforcement of the <br />City's lawful gambling ordinance. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />6 <br />
