MINUTES <br />CITY COUNCIL <br />FEBRUARY 9, 2011 <br />RAILROAD <br />CROSSING <br />AGREEMENT <br />be assessed dividing the assessment for the outlot among the Dianna Lane <br />properties. If that assessment is contested, the assessment could be <br />withdrawn and the project reassessed with the outlot being assessed <br />directly. <br />Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -2 -39 APPROVING PLANS AND <br />SPECIFICATIONS AND ORDERING ADVERTISEMENT FIR BIDS <br />FOR THE FOLLOWING IMPROVEMENTS: <br />IMP. NO. 2011 -05 <br />8 <br />ONTARIO ROAD; <br />JESSICA COURT; <br />PAYNEAVENUE; <br />DIANNA LANE <br />The foregoing resolution was duly seconded by Keis. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />The City Administrator noted that the City's trail over the waterworks <br />property has never been completed given the need to cross the Burlington <br />Northern railroad tracks. The City has been working on a trail crossing <br />agreement with BNSF Railway Company for several years, and has finally <br />received the trail crossing documents. The Administrator reported that to <br />keep the process moving the City needs to approve the license agreement <br />attached, remit $7,000 in contract fees to BNSF Railway Company, and <br />purchase Railroad Protective Liability Insurance at a cost of $500 to cover <br />the construction period. The Administrator reported that the insurance <br />certificate has already been obtained from the League of MN Cities <br />Insurance Trust and submitted to the railway company. <br />The Administrator stated that he was not sure of the actual cost to <br />complete the trail segment at this time. Those cost estimates would be <br />updated and reported to the Council. Blesener asked who would do the <br />trail work. The Administrator indicated that it was his understanding that <br />the railway company would do the work within the track right -of -way. <br />The City would do the work outside the railroad right -of -way. The <br />Administrator indicated that the cost of finalizing the license agreement as <br />well as the actual trail work would come from the Trails Infrastructure <br />Fund. <br />It was noted that the waterworks trail will eventually connect with trails in <br />Shoreview once the Rice Street bridge over 694 is reconstructed. <br />
