MINUTES <br />CITY COUNCIL <br />FEBRUARY 23, 2011 <br />AMEND Montour opened the Public Hearing to consider the application for an <br />CUP Amendment to Conditional Use Permit to increase the amount of <br />2958 outdoor storage area from 4,000 square feet to 6,000 square feet as well <br />YORKTON as a Variance to allow an expanded outdoor storage area in the side yard <br />BLVD. at 2958 Yorkton Blvd., AMR Properties. He noted that the City Planner <br />AMR and the Planning Commission recommended approval subject to <br />PROPERTIES conditions. <br />The City Planner reviewed the application for Amended CUP and <br />Variance. He noted that a CUP and Variance was granted for this property <br />in 2006. The applicant is looking to expand his outdoor storage area, <br />therefore, is requesting the Amended CUP and Variance. The Variance is <br />necessary due to the location of the outdoor storage area which is <br />technically in the side yard of the property. The Code defines front yard <br />as the narrow side of a corner lot; therefore, while the building faces to the <br />west, the east side of the building (outdoor storage area location) is <br />considered to be a side yard. <br />The City Planner reported that staff is recommending approval of the CUP <br />amendment consistent with the terms of the original permit. He also <br />recommended approval of the Variance expansion noting that the request <br />is supportable given the technical rear yard of the property (north side) <br />would not be able to accommodate outdoor storage as storage in that <br />location would interfere with the circulation of the site as well as the <br />neighboring property. Therefore, a hardship is present to justify the <br />variance. The Planner then reviewed his recommended conditions of <br />approval as outlined in his February 4, 2011 report. <br />Tom Kromroy, AMR Properties, reported that he agrees to comply with <br />the City Planner's recommendations. <br />Keis asked about snow storage on the property and its impact on required <br />landscaping. The City Planner reported that the landscaping proposed <br />would not be harmed by snow storage. <br />McGraw asked about the recommendations of the Fire Marshal. Kromroy <br />reported that he is currently working with an architect to comply with fire <br />codes. He indicated that one solution may be to install panic hardware on <br />the gates in the fencing surrounding the outdoor storage area. While the <br />gates would be locked from the outside, the panic hardware would allow <br />someone to exit the storage area. <br />The City Administrator indicated that if the Council is inclined to approve <br />the CUP and Variance requests, the approval be subject to resolution of <br />2 <br />
