MINUTES <br />CITY COUNCIL <br />FEBRUARY 23, 2011 <br />CONSENT <br />AGENDA <br />Ms. Boss introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2011 -2 -49 APPROVING THE CONSENT <br />AGENDA WHICH CONTAINS THE FOLLOWING: <br />*APPROVAL OF THE VOUCHERS; <br />*APPROVAL OF WORKER'S COMPENSATION DEDUCTIBLE; <br />*APPROVAL OF TEMPORARY LIQUOR LICENSE FOR ST. <br />JOHN'S CHURCH SILENT AUCTION ON APRIL 29, 2011; <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />TOBACCO The City Attorney reviewed the history of tobacco licensing laws which <br />SHOPS were put in place to protect minors and prevent their access to tobacco <br />products. The Attorney noted that there is a new area of tobacco sales <br />developing relative to smoke shops, the sampling of tobacco, and the sale <br />of tobacco paraphernalia. The Attorney reported that the law does not <br />regulate the sale of paraphernalia given that there is no nexus with the use <br />of hookahs and other paraphernalia and the use of drugs. He further noted <br />that the City's tobacco regulations have been put in place to protect public <br />health and safety and are applied equally to everyone. <br />With regard to the issue of tobacco shops and the City's ability to place <br />additional regulations on these shops, the City Attorney suggested a two <br />tier licensing system. The first tier would cover tobacco licensing for the <br />sale of tobacco products at gas stations /convenience stores, liquor <br />establishments, retail stores, etc. The second tier would be the regulation <br />of tobacco shops and would include additional regulation related to public <br />safety as well as limit hours of operation, etc. The Attorney suggested that <br />he draft a proposed ordinance for the Council's review as well as discuss <br />the issue with the surrounding cities in an effort to work toward uniformity <br />in these regulations. <br />The Council had a general discussion relative to the new type of tobacco <br />shop that is emerging, and agreed with the City Attorney's <br />recommendation relative to the two tiered licensing system. The <br />consensus of the Council was that the Attorney develop the draft <br />ordinance he suggested as well as discuss the issue with the surrounding <br />cities. The draft ordinance should then be presented to the Council for <br />consideration. <br />4 <br />
